외항상선 선원고용제도 개선에 관한 연구

국문 초록

최근 국내 상선선원의 실업률은 세계적인 해운경기의 장기불황과 한진해운의 파산 등으로 인하여 점차 확대되고 있다 . 따라서 자국선원의 고용 비율은 정체되어 있고, 외국인 선원의 비율과 비정규직 선원의 고용의 비율은 점차 증가되고 있는 추세이다. 한편, 해양수산부는 2018년 4월 ‘ 해운재건 5개년 계획’ 을 통해 침체된 해운업을 되살리겠다는 의지를 표명하였지만, 고용불안에 처한 상선선원에 대한 지원 문제는 아직 명확하게 밝히지 않고 있다. 특히 선원고용증진 문제와 더불어 비정규직의 정규직화 문제를 슬기롭게 해결해 나가는 것은 중요한 당면과제로 부각되어 있다 그러나 선원고용증진 문제와 정규직 전환문제를 동시에 추진할 경우에 선원비의 증가가 급격해지는 문제로 귀결되어 해운산업의 국제경쟁력 에 일정부분 부정적 영향을 미치게 된다. 따라서 선원의 고용문제를 바라볼 때 대외경쟁에 직접적으로 노출되어 있는 해운산업의 특성, 국내 해운기업의 상황, 기존제도의 장점과 단점 등을 적절히 감안할 필요가 있을 것이다. 이 연구는 청년 해기사들의 양질의 일자리 창출을 지향하는 현 정부의 정책 기조를 검토하고, 우리나라 선원의 고용현황 조사 · 분석, 해외설문조사, 주요 법령 등을 비교 · 분석하였으며 이를 통하여 외항상선 선원의 고용제도개선을 위한 법제도적 정비방안을 제시하였다.

영문 초록

While the unemployment problem of domestic seafarers has gradually expanded due to the long recession of the worldwide maritime economy and the bankruptcy of Hanjin Shipping, the employment of domestic seafarers has not increased, while that of foreign seafarers has continuously been increasing. On the other hand, the Ministry of Oceans and Fisheries expressed in April 2018 its willingness to reconstruct shipping industry suffering from long recession through implementing five-year shipping rebuilding plan , however it has not yet expressly announced to support merchant seafarers facing instability of employment. In particular, it has become a key issue that transferring from irregular jobs to regular ones together with employment promotion need to be wisely resolved. However, crew costs will rapidly increase if tries to resolve these two issues at the same time, which will result in affecting adversely the competitiveness of shipping industry. Thus, when looking at the issue of seafarer’s employment, it is necessary to adequately take account of characteristics of shipping industry exposed to unlimited competition internationally, the circumstances of national shipping companies, pros and cons of existing system, etc. This study scrutinized the current government policy direction aiming at high quality job creation for young officers, investigated and analyzed current status of national seafarers’ employment, conducted questionnaire survey for selected countries, and made comparative analysis of relevant laws and regulations, through which the amendment directions for furtherance of ocean-going seafarers was suggested.
