국문 초록

행정법을 둘러싼 환경의 변화에 따라 여러 행정법의 발전과제가 제기된다. 그 동안 행정환경의 변화에 따른 행정법제도, 행정판례 및 행정법학의 발전이 주로 연구의 대상이 되었다. 그렇지만, 행정법이론의 발전과제를 전반적으로 논하는 연구는 많지 않았다. 이 글에서는 행정법 환경의 변화에 대응한 행정법 일반이론의 발전과제를 도출하고 그에 대한 개괄적인 해결의 방향을 제시하고자 한다. 법질서내에서의 행정법의 위치를 재조정하여야 한다. 공법과 사법의 구별을 전제로 행정법과 사법과의 관계와 행정법의 사법과의 통합을 모색하여야 한다. 행정법과 헌법과의 바람직한 관계를 정립하여야 한다. 행정법이론의 권위주의적 요소를 씻어내고. 민주법치행정법학을 이루어야 한다. 이러한 전제하에 공익의 보장을 행정법의 과제의 하나로 보아야 한다. 행정의 민주화가 어느 정도 달성된 지금은 국민의 권리보호와 함께 행정에 의한 공익의 보호를 고려하여야 한다. 행정의 효율성도 고려하여야 한다. 행정과 민간의 관계를 재정립하여야 한다. 민간의 행정참여, 민간위탁에 관한 행정법이론이 재정립되어야 한다. 규제완화를 규제합리화로 대체하여야 하고, 규제론을 행정법이론으로 포섭하여야 한다. 행정정보화가 상당히 진전된 현재 행정정보화는 입법적 대응뿐만 아니라 행정법이론의 변화를 요구하고 있다 향후 행정법이론의 연구에 있어서는 행정의 정보화를 고려하여야 할 것이다. 마지막으로 보편타당하고 합리적이면서도 우리의 현실에 맞는 한국행정법이론을 정립하고, 세계행정법학계의 주목할만한 일원이 되어야 한다. 향후 행정법 환경의 변화에 따른 행정법이론의 발전과제에 관하여 학계에서 보다 심도있는 연구가 계속되어 행정법학계가 공감하는 행정법이론의 발전과제를 도출하고 그에 대한 해결책을 함께 제시하여야 할 것이다.

영문 초록

The Changed environment of administrative law has brought up various development issues on administrative law. Until now, system, precedent and improvement of administrative law in accordance with changes surrounding administrative environment have been a research subject mainly. However, researches have been seldom to discuss the overall developmental issues of the theory of administrative law. This article is drawing the developmental issues of he general theory of administrative law in response to environmental changes of administrative law and is offering possible solution about it. The position of administrative law should be adjusted in legal order. It shall seek differences and integration between administrative law and private law based on distinguishing public law from private law. It shall establish a desirable relationship between administrative law and constitutional law. They should eliminate authoritarian elements of administrative theory, and build up democratic-ruled of laws administrative law. Premised that above, securing public interests should be admitted a part of issues of administrative law. Now, democratization has been achieved in the field of administration, it should consider protecting rights of the people and public interests by administration. And It should consider the efficiency of the administration. Additionally, the relationship between administration and private sector should be redefined. The theory of administrative law over civil participation to administration and contracting-out should be reestablished. Deregulation policy should be replaced by rationalized regulation policy, and regulation theory should be embraced by theory of administrative law. Currently, administration-informatization has been built up and it requires not only legislative response and but also change of theory of administrative law. Studying theory of administrative law in future, they should consider administration-informatization. Finally, We should set up the universal, valid and realistic theory of administrative law universally and become a remarkable member in the field of administrative law globally. The study about development issues of the theory of administrative law due to changes in administrative law environment should be kept more in-depth research in future, draws development issues of theory of administrative law which could be in agreement in the academia of administrative law and offers solution for it.
