신체촬영범죄의 관련 법률과 수사실무상 쟁점 검토

국문 초록

최근 사람의 신체를 촬영하는 범죄에 대해서 사회적으로 큰 관심이 쏠리고 있지만, 수사실무에서 참고할 수 있는 매뉴얼조차 없는 상태이다. 본 논문은 신체촬영범죄에 대하여 수사실무에서 법집행이 제대로 이루어지기 위한 프로토콜을 제시하는 것을 목적으로 한다. 피촬영자는 자신의 신체가 촬영당했거나 그 촬영물을 촬영자가 소지하고 있다는 이유로 수사기관에 촬영자의 처벌을 요구하고 있다. 수사실무가는 처벌가능한 법률들과 관련판례의 태도를 미리 숙지한 후 신고내용에 따라 의율가능한 적당한 법률을 찾아내고 증거를 수집하여 촬영자를 검거, 조사해야 한다. 본 논문에서는 신체 촬영범죄에 의율되는 법률 4가지를 비교검토하였다. 그런 다음 법령과 대법원 및 하급심 판례를 통해 쟁점별 해석을 시도하였다. 끝으로 수사실무 과정에서 드러난 문제점에 대하여 교육적 측면에서 수사관의 직무교육 필요성과 수사자료 접근의 개선방안을 정책적 대안으로 제시하였다.

영문 초록

Crimes concerning taking pictures of the human body have recently captured huge attention across society. The purpose of this study is to propose a set of protocols to ensure the law enforcement officer in practical affairs of investigation into crimes. Victims in such crimes ask an investigative agency to punish their perpetrators as they have taken pictures of their bodies or possess pictures of their body parts. In an investigation, practitioners need to get familiar with the attitudes in punishable acts and related precedents, find applicable acts and collect evidence according to the content of a report, and arrest and investigate the perpetrators. The present study compared and reviewed four applicable acts. The study then identified major issues from acts and interpreted them based on concerned laws, Supreme Court decisions and the trial and appellate courts decisions instance. Finally, the study proposed policy alternatives for the problems revealed in the actual investigation process from the standpoints of practitioners of investigation.
