양형기준에서 일반양형인자의 실효성 검증 및 효율성 제고 방안

국문 초록

양형위원회는 양형인자를 질적으로 구분하여 양형의 목적인 균등성과 적정성을 확보 하고자 하였다. 특별양형인자는 권고영역을 결정하고, 일반양형인자는 다른 양형요소와 함께 권고영역에서 선고형을 결정할 때 고려된다. 이렇듯 일반양형인자가 양형기준 내에서 독자적 역할을 하지 못하기 때문에 양형기준 시행 초부터 우려의 목소리가 있었다. 그리고 양형기준 시행 10여년이 지난 현재, 일반양형인자의 존치여부까지 논의의 장에 올라오고 있다. 그러나 양형기준이 양형인자의 질적 구분에 의해 양형의 등급이 정해지는 우리나라만의 독창적인 제도라는 점에서 일반양형인자의 존재가치는 의미가 있다고 할 수 있다. 남겨진 과제는 일반양형인자의 효율성을 극대화시킬 수 있는 방안을 모색하는 것이다. 이 연구에서 일반양형인자가 실무에서 어떻게 고려되고 있는지를 확인하기 위해 판결문을 분석하였다. 그 결과 거의 모든 판결문에서 일반양형인자에 해당하는 양형 요소가 존재함에도 불구하고 양형기준의 적용과정에 누락되어 있음을 확인하였다. 아마도 일반양형인자의 모호한 역할과 작량감경사유와 내용상 유사점 등이 일반양형 인자의 명시적 기재를 생략하게 만드는 것이라 추측해 볼 수 있다. 양형위원회는 양형기준의 높은 준수율을 부각시키고 있다. 양형기준의 준수는 판사의 내심이 아니라 판결문에 양형이유의 명시적 기재를 통해 확인할 수 있다. 일반양형 인자가 특별양형인자와 비교하여 그 역할이 모호하다고 하여 판결문에 명시적 기재를 누락시켜서는 양형 및 양형과정의 투명성을 담보할 수 없다. 판결문의 양형이유에서 유·불리한 정상 및 작량감경사유에 뒤섞여 있는 일반양형인자를 찾아내어 제자리를 찾아주려는 노력이 필요하다. 또한 일반양형인자가 선고형에 이르는 과정에서 특별 양형인자와 작량감경사유의 보충적 지위, 소극적 지위가 아닌 양형기준 내에서 적극적 지위로 자리매김할 수 있는 구체적 방안을 제시하였다. 즉 일반양형인자를 평가하여 권고 형량범위에서 선고형을 결정하게 되면 이중평가금지원칙을 준수함과 동시에, 종래 문제시되어 왔던 양형기준의 넓은 형량범위를 통제할 수 있는 합리적 방안이 될 것이다. 물론 이 과정에서 양형인자의 비교 형량을 더 효율적으로 수행하기 위해서는 기존 양형인자의 재평가와 양형기준에 포함되지 않은 새로운 양형인자의 발굴이 반드시 병행되어야 할 것이다.

영문 초록

Sentencing Council tried to ensure the uniformity and appropriateness of the sentencing purpose by dividing the sentencing factors qualitatively. The special sentencing factors determine the recommended sentencing range, and the general sentencing factors are considered when determining adjudgment in the recommended sentencing range with other sentencing factors. As such, there have been concerns since the beginning of the implementation of sentencing guidelines since the general sentencing factors do not play an independent role within sentencing guidelines. And now, 10 years after the implementation of sentencing guidelines, it is debated whether the general sentencing factors will be maintained. However, the existence of the general sentencing factor is meaningful in that the sentencing guideline system is unique to Korea, where the grade of sentencing is determined by qualitative division of sentencing factors. The remaining task is to find ways to maximize the efficiency of the general sentencing factor. First, compliance with sentencing guidelines can be confirmed by noting the judge s intent, but by explicitly stating the reasons for determination of punishment in the sentencing. If an explicit statement is omitted in the sentencing because the general sentencing factor plays an ambiguous role in comparison with the special sentencing factor, the transparency of the sentencing and sentencing process cannot be guaranteed. Efforts should be made to find the general sentencing factors that are mixed with the favorable and unfavorable circumstances, and mitigation of punishment in extenuation of circumstances in the reasons for determination of punishment in the sentencing. Second, in the process of reaching the sentence I suggested a concrete way that the general sentencing factor can be positioned as an active position within the sentencing guidelines rather than the complementary status and passive status of the special sentencing factor. that is, the sentence is determined in the recommended sentencing range by evaluating the general sentencing factors. Of course, in this process, reassessment of the sentencing factors and finding new sentencing factors not included in the sentencing guidelines must be performed concurrently.
