국문 초록

생명윤리법정책은 의학과 생명과학의 새로운 지식체계에 대하여 사회적 함의와 정당성을 비판적 으로 고찰하여 그 결과를 생명윤리의 쟁점이나 그로 인한 사회적 갈등을 해소하기 위한 규범체계 마련을 위한 법적 접근을 의미한다. 생명윤리법정책의 근간이 되는 생명윤리법제는 법률의 경직성으로 인해 매우 빠르게 발전하는 생명과학기술이 즉각적으로 반영되지 못하는 입법 기술상의 한계가 있어 현실과의 간극이 존재한다. 이러한 생명윤리법제의 제한점으로 인해 유전자 치료와 같은 첨단 의생명과학기술의 특수성을 고려하고 기존의 안전성 검증체계 적용의 한계 등을 극복할 수 있는 생명윤리법제의 규제 패러다임의 변화가 필요하다. 다만 생명윤리정책의 방향은 바이오기술 도입에 따른 경제성이나 활용가능성에 대한 기대와 기여가능성이 불확실한 위험을 고려한 규제와 균형을 이루고 인간의 존엄성을 포함한 생명윤리적 쟁점에 대한 검토가 함께 이루어져야 한다. 이를 위해 바이오 기술의 가치에 대한 사회적 합의와 공론화가 이루어져야 하고 그 과정에서 과학자뿐 아니라 시민 사회 전체가 주체적으로 그 역할을 수행할 수 있어야 한다.

영문 초록

The bioethical law and policy means a legal approach to critically examine the social implications and legitimacy of the new knowledge system in medicine and life sciences and to establish a system of norms to resolve the issues of bioethics and the resulting social conflicts. The bioethics legislature, which is the basis of the bioethical law and policy, has a gap with reality because of limitations of legislative technology that can not be immediately reflected in biotechnology that develops rapidly due to the rigidity of the law. Due to the limitations of the bioethics legislature, it is necessary to consider the specificity of advanced biotechnology such as gene therapy and to change the regulatory paradigm of bioethics legislation that can overcome the limitation of application of the existing safety verification system. However, the direction of the bioethics policy should be balanced with regulations considering the risks of uncertainty, the economic feasibility and availability of biotechnology. At this point, a review of bioethical issues, including human dignity, should be made together. To this end, social consensus and publicity about the value of biotechnology should be made and the whole civil society as well as scientists should be able to play its role.
