국문 초록

2016년 남중국해 문제에 대한 필리핀-중국간의 중재재판 판정에 따라 남중국해 해양개체의 법적 지위에 관한 권위 있는 국제법원의 판정이 나오게 되었다. 이에 따라 남중국해를 군사적 및 상업적 목적 등 주요 항로로 이용하고 있는 미국과 중국이 이 수역에서의 선박 특히 미국의 군함이 중국이 주장하는 남중국해 해양개체(특히 인공도서)의 주변수역을 통항하는 문제에 예민한 반응을 보이게 되었으며, 심지어는 군사적 충돌로도 이어질 수 있는 상황으로 까지 전개되었다. 이러한 배경에 따라, 본고는 유엔 해양법협약상의 통항제도를 검토하고, 미국이 주장하는 소위 “항행의 자유작전“과 중국의 “일대일로” 정책(해상실크로드정책)에 통항제도가 미치는 영향 및 문제점을 관련 국제법규 및 국가관행 등 근거로 분석하여 남중국해 및 기타 해양에서의 양국간 통항 문제 갈등 해결을 위한 법적 근거 또는 바람직한 대안을 제시하고자 한다.

영문 초록

The 2016 Arbitration Award on the legal status of maritime features in the South China Sea (the SCS) was issued after the Philippines brought the dispute to the Permanent Arbitration Court against China in 2013. So, USA and China using the SCS as one of the major sea routes for commercial and military purposes are showing sensitive responses with regard to the passage of warships through the territorial sea and as a result of that, a military conflict may be seriously anticipated. Under the consideration of the above circumstances, this paper mainly focuses on the passage regimes in the UN Convention on the Law of the Sea (the UNCLOS) and then, it will analyse the impact of the UNCLOS on the so called “Freedom Operation of Navigation” and “One Belt One Road” policies. Finally, this paper will suggest desirable way and legal grounds for the settlement of the conflicts and disputes on the passage regimes which both nations are currently having in the South China Sea and others including the Indian Ocean.
