우리나라 외근경찰의 경찰봉 사용 한계 설정에 관한 연구

국문 초록

경찰봉은 동서고금을 막론하고 총기와 더불어 경찰 공권력을 상징하는 대표적인 휴대무기의 하나이며, 우리나라의 경우에도 일선 지구대, 파출소 외근경찰관뿐만 아니라 집회시위 현장에서도 매우 빈번하게 사용되고 있다. 지난 1991년 3월 미국 캘리포니아주 로스앤젤레스에서 발생한 로드니 킹 구타 사건에서 보듯 경찰봉 사용은 반드시 엄격한 사용 한계 설정을 통해 철저히 규제 되어야 한다. 그러나 우리나라의 경우 경찰봉 사용과 관련된 매뉴얼이 정비되어 있지 않으며, 관련 연구 역시 전무한 현실이다. 이러한 경찰봉 사용과 관련된 연구의 공백을 극복하기 위해 이 연구에서는 우리나라 법원의 경찰봉 사용 관련 판결, 미국 연방법원의 1871년 민권법 제1983조에 따른 경찰봉 사용과 관련된 민사소송 판결, 미국 경찰관서의 경찰봉 사용 가이드라인을 바탕으로 우리나라 경찰의 경찰봉 사용 한계 설정을 시도하였다. 비교 분석 결과, 이 연구에서는 경찰봉은 경찰관 또는 무고한 제3자에 대한 신체적 폭력 이상의 위해를 가하는 경우 통상적인 타격무기로 사용될 수 있을 뿐만 아니라 대상자가 정당한 경찰관의 지시, 명령을 따르지 않거나 소극적으로 저항하는 경우 경찰봉 양끝을 잡고 대상자의 신체에 밀착한 상태에서 대상자를 밀거나 끄는 등 격리도구로서도 사용될 수 있도록 설정하였다. 또한 이 연구에서는 대상자가 경찰관 또는 무고한 제3자의 생명·신체에 대해 중대하고 급박한 위해를 야기함으로써 형법상의 정당방위 또는 긴급피난이 성립하는 상황에서 이를 제압할 수 있는 여타 경찰장비 사용이 불가능하거나 무력화된 경우 예외적으로 경찰관이 경찰봉을 총기 대용의 살상무기로도 사용할 수 있도록 제안하였다. 경찰봉의 효과적이고 안전한 사용을 위해서는 경찰관 1인이 권총, 전자충격기, 호신용 최루액 분사기, 경찰봉 등 일련의 휴대무기를 모두 휴대하도록 하는 외근경 찰관 휴대무기 체계 개편, 경찰봉 사용 훈련 실시 및 평가 체계 도입 등이 뒷받침되어야 할 것으로 제안된다.

영문 초록

Historically, police batons, along with police handguns, have been adopted in many police departments worldwide. Police batons are also extensively used not only for ordinary law enforcement activities but for assembly and demonstration situations in Korea. As seen in the police beating of the motorist, Rodney King in 1991, police use of batons can cause serious damages to citizens, requiring proper use of police batons to be guided by internal regulations and policies. Nevertheless, the Korean National Police Agency has failed to establish a guideline for its officers’ use of police batons yet. Therefore, the current study attempted to fill the gap in research and practices by analyzing not only court cases regarding police use of batons in Korea and the United States but police use of baton guidelines adopted in major American police departments. Upon analysis, the present study found that police officers can use a baton as an impact weapon to subdue physically resisting subjects. Futhermore, police officers can use the weapon as an escort tool when controlling uncooperative citizens. Finally, police officer can use batons as a deadly option when dealing with deadly force assailants. For proper and safe use of police batons, the Korean National Police Agency is recommended to fully revise the current weapon carrying system by requiring all of its officer to carry all force options available, including handguns, tasers, OC sprays, and batons. Additionally, adequate training and evaluation programs must be devised to fully prepare officers for various duties.
