현행 헌법의 제왕적 대통령제와 권력구조 개편 방안

국문 초록

우리나라 대통령제는 지속적으로 그 문제점을 개선하면서 우리 정치 문화적 토양에 적응하며 진화하고 발전해 왔다. 그러나 대통령 1인에게 과도한 권력의 집중으로 ‘제왕적 대통령제’로 변질되어 그 폐해가 드러난 바 있다. 따라서 이를 개선하기 위해 대통령의 권한을 합리적으로 축소조종하고 실질적인 민주적 통제를 강화시키는데 방점을 두면서, 우리 정치문화에 부합하는 권력구조로의 개편 방안에 대해 고찰해 보았다. 이러한 맥락에서 향후 개헌 논의에 있어서 주요 기준점이 될 대통령 개헌안 중 권력구조와 관련된 구체적인 쟁점사항을 중심으로 비교하여 검토해 보았다. 우리 헌정사에서는 단 한번도 순수한 형태의 대통령제를 시행해 본 경험이 없기 때문에 미국의 대통령제를 통하여 그 시사점을 얻고자 하였다. 국민이 직접 정부선택권을 갖는 현행 대통령제를 유지하면서 보다 엄격한 권력분립을 통해 대통령의 권한을 축소하고 우리 현실에 적합한 내용을 담아내는 것이 필요하다. 이러한 개선방안으로 대통령 4년 중임제, 정 부통령 러닝메이트제 도입, 국무총리제 폐지, 국회의원의 장관겸직 금지, 정부의 법률안제출권 폐지, 국회의 재정통 제권의 강화, 헌법개정 국민발안제 도입 등을 제시해 보았다. 그러나 어느 권력구조나 정치제도이든 모두 그 제도적 장단점을 가지고 있음을 살펴본 바와 같다. 따라서 ‘제도’ 그 자체의 개선도 중요하지만 무엇보다도 이를 운영하는 ‘사람’의 문제가 더 중요할 수 있다. 우리의 정치적 현실에서 “모든 문제의 출발은 대통령이고, 그 귀결도 대통령”이라는 함의를 결코 간과할 수 없다고 본다. 이제 헌법규범을 대통령 중심의 우월적 사고의 틀에서 벗어나서 민주적 권력구조로의 개편방안을 진지하게 모색해야 할 때이다.

영문 초록

The Korean presidential system continuously evolves and adapts to our political and cultural soil while improving the problem. However, the concentration of excessive power to the president has been transformed turned into a ‘imperial presidential system’ and the harmful effects has been revealed. Therefore, in order to improve this, we discussed ways to restructure the power structure in line with our political culture, focusing on rational curtailment of the president s powers and strengthening actual democratic control. In this context, we compared specific issues related to the power structure among the presidential constitutional amendment, which will be the main reference in the discussing constitutional amendment in the future. Since we have never experienced a pure form of presidential system in our constitutional history, we wanted to get that suggestion through the U.S. presidential system. It is necessary to maintain the current presidential system in which the people have the right to choose the government, to reduce the power of the president through a more strict separation of powers, and to provide contents suitable for our reality. These reforms included the adoption of the four-year presidential term-limitation, the adoption of the president and vice-president’s running mate system, the abolition of the prime minister’s system, the abolition of the right to submit a bill to the government, the strengthening of the fiscal control of the National Assembly, and the introduction of the national constitutional amendment bill. However, we have seen that any power structure or political system has its institutional strengths and weaknesses. Therefore, improvement of the ‘system’ itself is important, but more importantly, the problem of ‘people’ who operate it may be more important. In our political reality, we can never overlook the implications of “the beginning of every problem is the President, and the consequences are the President.” Now it is time to seriously seek ways to revolve the constitutional norm into a democratic power structure by escaping the framework of presidential-centered thinking.
