국문 초록

이 연구는 문재인 정부가 추진 중인 자치경찰제도의 도입에 앞서 그동안 논의의 대상에서 벗어나 있던 해양경찰의 지방자치화 여건 및 지방자치화 실현 가능성, 그리고 향후 전망과 고려사항을 검토해 보는데 의의가 있다. 해양경찰의 지방자치화 여건 및 실현가능성에 대하여는 ① 해양경찰의 정체성과 특수성의 관점, ② 현행법상 자치경찰제 관련 법 규정의 관점, ③ 외국 자치경찰제도와의 비교 등 세 가지 측면에서 검토하였다. 해양경찰의 지방자치화 전망 과 고려사항에 대하여는 ① 해양경찰의 자치화는 선택의 문제인가 당위의 문제인가, ② 현재의 국가해양경찰제를 그대로 유지한다면 지방자치제도와 어떻게 조화시킬 것인가, ③ 새로운 자치해양경찰제로 개편한다면 어떠한 형태로 운용할 것 인가 등 세 가지 관점에서 검토하였다. 해양경찰의 지방자치화는 지방행정과 연계된 해양치안을 구현할 수 있고, 지역 특성에 적합한 해양치안 서비스를 제공할 수 있는 장점이 있다. 다만 우리나라의 해양경찰 조직은 육상경찰과는 다른 차원의 특수성이 존재하므로, 육상경찰과 동 일한 맥락에서 단순히 지방행정제도의 개편쯤으로 접근한다면 실패할 가능성이 크고 오히려 현재의 국가해양경찰제도보다 못하다는 평가를 받기에 충분하다. 따라서 이 분야에 관한한 법학, 행정학, 경찰학, 국가안보학, 해양학 등 유관 분야의 학제적 접근을 통한 보다 심도 있는 논의와 접근이 필요하다.

영문 초록

This study is about the possibility of changing the current korean coast guard system to self-government system. To study the conditions and feasibility of localization of the korean coast guard, I reviewed three aspects: ① the identity of the korean coast guard and it s specificity; ② the view of the current law on the korean self-government police system; and ③ the comparison of the korean coast guard system with foreign system. And To study the prospects and future of the korean coast guard s localization, I reviewed three aspects: ① the autonomy of the coast guard is a matter of choice or merit? ② how do we harmonize with the local autonomy system if the current coast guard system is maintained? ③ what is the future shape of korean coast guard if we change the current system to self-government system. In korea, the korean coast guard organization has its originality and distinctiveness to the land police organization. Therefore, it is highly likely that if we approach simply reorganizing the coast guard system in the same context as the land municipal police system, It is enough to be judged to be less than the current national coast guard system. Therefore, in this field, more in-depth discussion and approach is needed through interdisciplinary approaches in related fields such as law, administration, police science, national security, oceanography and so on.
