독일의 아동수당(Kindergeld) 제도와 한국적 함의

국문 초록

아동수당 제도는 아동이 건전하게 성장할 수 있는 환경을 마련하기 위한 아동 친화적 정책이며, 현대 복지국가의 근간을 이루는 주요 제도 중의 하나라고 할 수 있다. 독일의 출산 및 아동양육 법제는 이미 19세기 비스마르크 시절부터 발전한 것으로 독일 노동법 및 사회보장법제의 근간을 이루고 있다. 오늘날 독일에서는 자녀를 키우는 일을 개인과 가정의 일로만 보지 않고, 사회가 지원하고 책임져야 한다는 사회적 합의가 다양한 형태의 지원정책(Kindergeld, Elterngeld, Betreuungsgeld, Kinderzuschlag)과 법제(Kinder-Jugendhilfegesetz, Mutterschutzgesetz, Kindergartengesetz, Bundeskindergeldgesetz)가 실행되고 있다. 삶의 질을 우선시하는 독일정부는, 궁극적으로 아동복지를 위해 공동의 책임감을 가지고 예산을 아끼지 않는다. 최근 독일의 출산율의 상승은 아동양육을 위한 아낌없는 정부 정책과 지원의 결과다. 독일의 출산장려정책은 노동법 및 사회보장제도를 가족 친화적으로 개선하고, 보육시설을 확충하여 직장과 자녀양육을 병행할 수 있도록 지원하는 데 초점을 맞추고 있다. 한국의 아동수당 제도의 도입과 시행에 있어서, 독일의 사례에서 참고할 수 있는 정책적 함의는 아래와 같다. 첫째, 아동수당 제도의 적극적 추진과 더불어 지원 대상 및 급여수준의 확대가 필요하다. 둘째, 한국 사회의 저출산 문제를 해결하기 위해서는 도입예정인 아동수당 제도에 출산장려기제가 추가될 필요가 있다. 셋째, 아동수당 제도는 급여수준, 대상선정, 재원조달등 제도의 설계방식에 따라 다양한 형태의 시행이 가능하다. 넷째, 아동수당 제도의 실행은 아동의 기본적 권리와 복지를 증진함에 있지만, 한국사회의 심각한 저출산 문제를 해결하기 위한 정책수단이기도 하다. 출산율을 높이기 위한 전제조건은 청년실업의 해소, 안정적인 일자리 제공, 주거안정, 가족 친화적 법제, 노동시장에서의 남녀에 대한 평등한 대우, 영·유아에 대한 공공보육시설의 확충이다. 그러한 전제하에서만 아동수당 제도가 지향하고 있는 목표가 달성될 수 있을 것이다.

영문 초록

The Child Allowance System is a child-friendly policy for the environment in which children can grow soundly and is one of the main institutions that form the foundation of the modern welfare state. The German birth and child rearing legislation has already been developed since the 19th century and forms the basis of German labor and social security legislation. In Germany today, raising children is not seen as a personal and family affair. Various forms of support policies (Kinderergeld, Betreuungsgeld, Kinderzuschlag) and legislation (Kinder-Jugendhilfegesetz, Mutterschutzgesetz, Kindergartengesetz, Bundeskindergeldgesetz) are being implemented under the social consensus that the society should support and account for childcare. The German government, which prioritizes the quality of life, does not spare a budget for child welfare. The recent birth rate in Germany is the result of generous government policies and support for childcare. Germany s childbirth policy focuses on improving the labor law and social security system in a family-friendly way, and expanding childcare facilities to support work and child care. In the introduction and implementation of the child allowance system in Korea, the policy implications that can be referred to in Germany are as follows. First, it is necessary to actively promote the child allowance system and to expand the scope of the support and the level of benefits. Second, in order to solve the problem of low fertility in Korean society, it is necessary to add a mechanism to encourage childbirth in the child allowance system to be introduced. Third, the child allowance system can be implemented in various forms according to the design method of the system such as the level of salary, object selection, and financing. Fourth, the implementation of the child allowance system promotes the basic rights and welfare of children, but it is also a policy tool for solving the serious problem of low fertility in Korean society. The preconditions for raising the fertility rate are eliminating youth unemployment, providing stable jobs, stabilizing housing, family-friendly legislation, equitable treatment of men and women in the labor market, and expanding public childcare facilities for infants and young children. Under such premise, the goal of the child benefit system can be achieved.
