국문 초록

법의 정신과 그를 시행하고자 제정되는 현행법 사이에는 괴리가 있을 수 있다. 법에 대한 가장 소박한 이해에 따르면 법은 그 대상으로 하여금 도덕적/ 윤리적 삶을 영위하게끔 돕는다. 현행법이 이러한 법의 정신을 제대로 실현 내지는 구현하고 있는가에 대한 물음은 법학자 뿐 아니라 법의 제정에서부터 그 시행까지의 법 관련 산업에 종사하는 이 모두의 책임이자 의무라 생각한다. 이 논문에서는 미국 연방 법원과 대법원 판결 중 랜드마크 판례 중 일부를 분석하여 그 도덕적 의의를 소개하고자 한다. 한국의 대법원, 헌법 재판소 판결의 도덕성/윤리성 을 포함한 다양한 분석의 촉진에 이바지하고자 한다.

영문 초록

The law helps, allows, or does not hinder people to conduct lives ethically. While this must be the spirit of the law, the positive law may or may not implement this goal as well as it should. When the laws are implemented, there remains Those who are to implement the goal become responsible also to carefully consider the manners of the enforcement. This paper presents the landmark decisions in the United States. The hope is to establish that the study on the legal cases helps determine the society’s legal and moral standing. More importantly, this study hopefully allows more studies to be done on the cases that have been decided by the The Supreme Court and/or The Constitutional Court of Korea.
