국문 초록

화재조사의 핵심은 발화개소와 화재원인을 규명하는 것이며, 화재원인을 규명하기 위해서는 발화개소를 먼저 규명해야 하므로 발화개소는 화재조사의 핵심 중의 핵심이다. 공단에서 4개 공장이 화재로 전소되어 100억 원 이상의 피해가 발생된 화재사례에 대해 발화개소를 판정할 목적으로 목격자 진술을 분석하였다. 11명의 목격자 진술 등을 기초로 분석한 결과 발화개소는 화장실 전등이 저절로 꺼진 후에 화재경보벨이 울리고, 그 후 119신고 시에 연기와 화염 분출이 목격된 공장의 2층이 발화개소임을 입증하였다. 이해관계에 있지 아니한 목격자들은 시간경과에 관계없이 일관된 진술을 하고 있으나 이해관계에 있는 목격자들은 화재 진화 중이나 진화 직후에 한 진술과 시간이 경과한 후나 소송 중에 한 진술은 다르며 자신이 속한 회사 등에 유리한 진술을 하는 특징이 있었다. 그러므로 이해관계인에 대한 목격자 진술은 화재진화 중이나 직후에 문답식으로 구체적으로 확보할 것을 제안한다.

영문 초록

The core of fire investigation is to identify fire origin and cause. As it is necessary to identify the fire origin to identify fire cause, the fire origin is the core of fire investigation. This study analyzed the witness evidence of four factories destroyed by fire in the industrial complex that caused damage of over one billion won to judge the fire origin. Based on the statements of 11 witnesses, after the fluorescent light of a toilet went out by itself, a fire alarm rang. Then, the witnesses saw smoke and flames spewing in the second floor of the factory when reporting to 119. Their statement proved that the fire originated from the second floor of the factory. While witnesses who have no interest make consistent statement regardless of time, those who have an interest make different statements during or immediately after fire extinguishing from those after some time or during a lawsuit and tend to make statements for their company. Therefore, it is suggested that the witness of the interested parties should be specifically received in question and answer form during or immediately after fire extinguishing.
