국문 초록

의료인권복지적 기준과 인권적 관점에서 접근해온 서구와 달리 한국의 형집행 정지제도는 정치인 등의 특권층 수형자들에게는 왜곡된 방식으로 쉽게 악용이 되어 왔고, 서민수형자들에게는 매우 업격하게 적용되어 형집행정지제도의 정치화, 자본화, 계층화가 오랫동안 계속되어 왔다. 교정제도에 대한 공정성을 침해하는 이같은 심각한 경로의존적 모순은 교정행정에 대한 불신을 초래해 왔다. 특권층 수형자들에게 유리하게 작용한 형집행정지의 선택성의 심화의 원인은 형집행 정지제도의 법적규정이나 절차적 규정의 문제점에 기인하는 미시적 측면 외에 한국사회의 왜곡된 비민주적 사회구조의 복합성에 기인해 왔다. 따라서 한국의 형집행정지제도의 근본적 개선을 위해서는 미시적 측면만 아니라 한국사회의 총체적 구조의 모순에서 기인한 거시적 측면에서도 접근해야 한다. 그러나 이에 관한 선행연구들은 주로 법적, 행정적 측면에서 접근하여 형집행정지가 내포하고 있는 사회구조적 성격과 학제적 성격을 간과하여 왔다. 이에 본 논문에서는 선행연구들이 간과한 거시적, 학제적 측면에서도 한국의 형집행정지제도의 바람직한 방향을 독창적으로 제시하였다.

영문 초록

Our stay of sentence execution system has been abused by privileged prisoners like politician, entrepreneur through unjustifiable way and has been applied to ordinary, poor prisoners through very rigid procedure contrary to advanced countries which has put emphasis on medical-welfare aspect, human aspect in its operation. Therefore, its politicization, capitalization, polarization in korea society has been going on for a long time. A serious path-dependent contradiction like this which has violated fairness about correction system has brought about distrust on the stay of sentence execution system. The cause of its deep selectivity which has been favorably applied to privileged prisoners is caused by micro aspect related to its legal, procedual problems and Korea’s undemocratic complexity of social structure. Therefore, for its basic betterment, a stay of sentence execution system needs to be approached through micro aspect and macro aspect related to our total structural contradiction. But, existing studies about its problems has mainly emphasized on legal, administrative points and has ignored its social structural aspect, its interdisciplinary aspect. Therefore I asserted its desirable device through macro, interdisciplinary approach which existing studies has ignored.
