교정인권적 측면에서의 출소유형별 교정처우프로그램 효과성 비교연구

국문 초록

이 연구의 목적은 교정시설에서 실시하고 있는 교정처우프로그램이 재범에 미치는 영향을 실증적으로 검증하고, 이를 출소유형 중 가석방과 형기종료에 따른 차이가 있는지를 비교 분석하는 것이다. 이 연구의 목적을 달성하기 위해, 종속변수는 재범 중 재복역으로 측정하였으며, 독립변수를 교정기관에서 현재 실시하고 있는 교정처우프로그램 중 교도작업, 직업훈련, 교육훈련, 의료서비스, 교화상담 등으로, 그리고 통제변수는 인구사회학적 변수로 설정하였다. 연구대상은 2010년 전국 교정시설 중 경비등급에 따라 일반처우시설, 완화처우 시설, 개방시설, 중경비시설에 해당하는 대표적인 7개 교정시설에서 가석방과 형기종료로 출소한 수용자로 한정하였으며, 법무부 교정본부의 협조를 바탕으로 보라미 시스템을 활용하여 자료를 수집하였다. 이를 토대로, 출소유형을 가석방과 형기종료로 구분하고, 개별적으로 다중회귀 분석을 실시하였다. 분석결과, 형기종료에서는 남성일수록, 학력이 낮을수록, 징벌을 받을수록, 교정처우 중 교도작업활동을 받지 않을수록, 재범을 보다 더 많이 행하는 것으로 제시되었으며, 가석방에서는 남성일수록, 학력이 낮을수록, 재범을 보다 더 많이 행하는 것으로 제시되었다.

영문 초록

The purpose of this study is to verify empirically correctional program effects to recidivism which are implemented in correctional institute, and compare and analyze differences of its effects between parole and expiration of term of punishment, two of release type. In order to achieve the purpose of this study, this study measured the following variables : reincarceration of recidivism as a independent variable, the sorts of correctional programs as correctional industrial program , vocational training program, educational program, medical service and reform counseling as dependent variables, and sociodemographic variables as control variables. The subject of this study were limited to parolees and suitors who were imprisoned at the representative 7 institutes of national correctional institutes according to facility level from S1 to S4 in 2010. And based on the cooperation of the Korea Correctional Service of Ministry of Justice, we collected the data by using Borami system. Based on this data, identify the release types as parole and expiration of term of punishment, and analyze individually in OLS. As a result, in the case of expiration, it appeared higher intention to recidivism when they were men, when they had lower educational background, when they were more punished, they didn t have correctional industrial programs. In the case of parole, it appeared higher intention to recidivism when they were men, when they had lower educational background.
