국문 초록

이 논문은 2010년 7월에 제정된 미국 금융개혁법(Dodd-Frank Wall Street Reform and Consumer Protection Act)에 대한 내용과 동 법안의 효율성에 대한 분석을 하였다. 금융개혁법안은 기존 감독체계의 감독효율성 제고에 중점을 두기 보다는 오히려 감독기능을 소홀하게 했던 연준과 정부의 감독권한을 강화시키고, 감독하기가 애매모호한 자기자본매매 금지, 패니매 (Fannie Mae)와 프레디맥(Freddie Mac)에 대한 개혁안 부재, 금융위기와는 무관한 금융소비자보호국 신설 등 금융위기의 핵심이 빠진 법안이라고 할 수있다. 금융개혁법은 오히려 연준과 정부의 금융시장에서의 개입을 확대함으 로써 향후 경제성장의 저하를 불러오고 금융감독의 실패, 금융기관들의 대마 불사(too big to fail) 및 도덕적 해이의 문제 등 기존의 금융위기를 불러온 위험요인을 해소하지 못하고 있다

영문 초록

This paper discusses the impact of the Dodd-Frank Wall Street and Consumer Protection Act, and particularly focuses on the effectiveness of the Dodd-Frank Act. Dodd-Frank has strengthened the regulatory power of the Fed and the government, who have failed to supervise financial institutions engaging in excessive risk taking and unsound financial practices. Dodd-Frank’s ban on proprietary trading of banks will be difficult to enforce because banks can easily circumvent the rules, largely owing to the ambiguous nature of financial activities between customer driven trading and banks’ capital driven trading. And Dodd-Frank has created the Consumer Financial Protection Bureau, which has little relevance to the 2008 financial crisis. Dodd-Frank has increased government interventions which will stunt future economic growth and does not address the problems of regulatory failure, reform on Fannie Mae and Freddie Mac, “too big to fail”, and moral hazard which still remain.
