국문 초록

오늘날 한국사회는 국제사회의 주도적인 역할을 담당하는 국가의 면모를 다하면서 지금까지 경험하지 못한 다양한 외국인의 출입국과 이주 및 거주 증가, 영주자격자와 국적취득자의 증가 및 다문화사회 문제, 바람직한 사회통합정책에 대한 논의 등으로 혼란을 겪고 있으며, 이와 관련된 외국인범죄의 현황도 지속적으로 증가하고 있다. 일반적으로 외국인범죄가 발생하는 원인은 다양하다. 특히 미시적인 환경 원인으로는 외국인의 직업과 빈곤, 직종과 연령 등이 논의되고 있고, 거시적인 환경 원인으로는 한국사회의 정치 경제적 요인과 사회 문화적 요인들이 논의되고 있다. 이러한 외국인범죄는 내국인과 달리 범죄자의 신상이나 범죄경력정보 또는 범죄자 개인 식별정보 등을 확보하기 어려워 수사망을 피해가는 경우가 많으며, 불법체류자의 경우에는 우리 형사사법기관의 통제가 더욱더 어려운 것이 사실이다. 그럼에도 불구하고 경찰을 비롯해 외국인범죄 전담수사부서의 설치나 우범지역에 대한 치안력 증강, 불법체류자 단속 강화 등의 다양한 대책을 강구해 왔지만, 외국인노동자의 인권보호 및 다문화지원 정책 등도 외국인범죄 예방차원에서 이루어져야 할 것이다. 마지막으로 외국인범죄에 대한 예방을 위해서는 범죄예방 주체인 경찰과 민간의 협동치안이나 불법체류자에 대한 관심과 관리 그리고 잠재적 범죄 행위자에 대한 출입국관리를 통해 적극적인 대응을 실시해야 한다.

영문 초록

Today, Korean society is confused by the increasing role of the international community in the immigration, migration and residence of foreigners, increasing the number of permanent residents and nationality acquirers, the issue of multicultural society, and the desirable direction of social integration policy and the status of foreign criminals related to this is continuously increasing. Generally, the causes of foreign crimes vary. Particularly, micro- environment causes are discussed about occupation, poverty and age of foreigners. In addition, political and economic factors and sociocultural factors of Korean society are discussed as a macro environment cause. Unlike a Korean citizen, such a foreigner s crime is often difficult to obtain information about a criminal s criminal history, criminal history information, or criminal identification information. And in the case of illegal stay, it is true that our criminal justice agencies are more difficult to control. Nevertheless, it has taken various measures such as the establishment of the police investigation department, the crime investigation department for the foreign criminals, the enhancement of the security of the crime area, and the crackdown on illegal aliens. However, the protection of human rights of foreign workers and the policy of supporting multiculturalism should also be done in order to prevent crimes against foreigners. Finally, in order to prevent foreign criminals, police and civilian police, who are responsible for crime prevention, should be actively involved in the care and management of illegal immigrants and immigration control of potential criminal actors.
