현행 소선거구제의 정치적 타당성과 개선방안에 대한 연구

국문 초록

현재 우리나라에서는 국회의원 선거방식으로 소선거구제를 채택하고 있다. 그런데 최근 10차 개헌 논의가 정치권·학회에서 활발히 전개되는 가운데, 국회의원 선거제도를 개편하자는 주장이 제기되고 있다. 즉, 우리나라의 소선거구제는 한국정치의 고질적 병폐인 지역주의 고착화에 기여했다는 문제점과 우리나라는 인구 편중이 심해, 행정구역과 생활권이 일치하지 않은 경우가 많아 선거구 획정이 난감한 경우가 많기에, 소선거구제의 대안으로 비례대표제와 중선거구제 도입이 거론되고 있다. 그러나 비례대표제는 정당에 기속되어 있지 않은 후보는 국회의원 선거에 출마하는 것이 원천적으로 봉쇄되어 있어 공무담임권을 침해받을 수 있고, 중선거구제는 후보난립으로 후보자의 공약을 세밀히 살펴볼 수 없어, 유권자에게 후보선택의 어려움이 발생한다. 따라서 소선거구제를 유지하는 것이 현실 정치에서의 최선이다. 즉, 소선거구제를 폐지하기 보다는 그 시행방식에 대한 개선이 필요하다. 따라서 인구편차 문제에 대한 합리적인 해결책 도출을 위해, 선거구 획정위의 권한을 강화하고, 10차 개헌 시, 성문헌법 상에 선거의 공정성과 합리성을 강력히 보장하기 위한 표의 등가성을 강조하는 의무규정을 삽입하는 것도 필요하다. 아울러, 정당차원의 자구책으로서는 다양한 배경과 능력을 가진 후보들이 정치에 입문할 수 있는 기회를 기성 거대 정당이 제공해야 한다. 소선거구제는 국민의 정치적 선호체계를 완벽히 반영하지 못하는 불완전한 제도임은 분명하다. 그러나 선거제도의 큰 틀을 고치기보다는, 국민의 현실적 필요를 현행 소선거구제가 잘 반영하도록 정당 체계, 입법 실무, 사법부를 통한 보완 등 세부적인 방법론을 통해 제도의 실제 운영방식을 개선하는 것이 합리적이다. 특히 소선거구제가 현행 대통령제와의 조응성이 높기에, 내각제로의 권력구조 개편이 있기 전부터 선거제도 변경을 논하는 것은 시기상조이다. 범국민적으로 대통령제 지지 여론이 강한 현실상, 현행 소선거구제를 유지하는 것이 바람직하다.

영문 초록

Current Korean parliamentary election system is First Past The Post. While a bill for constitutional amendment is working its way through the Parliament by politicians and professionals, with some critics saying that the current system must be modified. The critics assert that the First Past The Post system has been the main cause of chronic regionalism of Korea and the main obstacle to solve the existing serious disparity between administrative district reorganization and social neighborhood community in Korea. Because of this, the system of proportional representation and medium constituency system is suggested as alternatives to design constituencies reasonably. However, no independent proportional representation candidate can run for parliamentary election under the current law, which means that the fundamental right of officials is infringed. Also, under the medium constituency system, a voter may find it difficult to choose who to vote for due to randomly flooded candidates and their election pledges. Therefore, the current First Past The Post system is the best political option for now. We would rather improve its operating practices than abolish it. Roles of the Redistricting Commissions should be broadened to offer a rational solution to the disparity stated above. It is desirable that a new constitution include a new clause which emphasizes the law of equal weighted votes to ensure the fairness and rationality of election. At political party level, Political diversity and open opportunities for a new candidate of diverse origins must be pursued and encouraged by major parties. It is certain that First Past The Post system is an incomplete system in that it does not completely reflect the real political preference system of people, but it is desirable that ways to improve its operating practices are drawn by parties, legislature, and judiciary themselves. Above all, the First Past The Post system fits with the current presidential system. Unless a conversion to cabinet government system is confirmed, it is still yet to reason on current electoral system. The majority of Korean people stand by the presidential system and we must not forget that constitution is a essence of people s will.
