뮤지컬 제작과정에서 계약유형의 연구

국문 초록

본 연구는 공연제작 과정에서 이루어지는 합의 내지 계약의 현실에 대한 문제의식과 함께 바람직한 공연계약의 모습을 제시하고자 공연제작 과정에서 이루어지는 계약의 유형을 사례를 통하여 연구해보고자 하였다. 이러한 목적을 달성하기 위하여 먼저 선행연구와 공연계약의 현황 등을 기초로 하여 다양한 공연계약을 ‘대관계약’, ‘저작권 관련 계약’, ‘출연계약’, ‘스태프계약’, ‘티켓판매대행계약’, ‘투자계약’, ‘외주계약’이라는 7가지로 유형을 분류하였다. 다음으로는 2007년부터 2011까지 최근 5년간의 10편의 뮤지컬 공연 사례에서 실제로 체결 된 공연계약서를 유형별로 분석하였다. 분석 결과, 공연계약서들은 같은 유형의 계약이더라도 사례마다 계약서의 명칭, 체계, 조항의 수 등 형식에 있어서 상당한 차이가 있었고, 실질적인 내용이 동일한 항목에서도 각 사례마다 구체화 정도는 달랐다. 또한 우월한 지위에 있는 당사자에게 매우 유리한 내용의 계약이 체결되고 있었으며, 전체적으로는 다른 계약분야와 비교하였을 때 공연계약의 두드러진 특성이라고 할 수 있는 ‘비전형성’, ‘비대체성’, ‘불명확성’, ‘불평등성’, ‘상호관련성’을 확인할 수 있었다. 이러한 연구결과는 공연제작 과정에서 서면계약의 필요성, 나아가 서면계약의 내용에 대한 구체화의 필요성을 인식시킬 뿐만 아니라, 향후 계약 당사자 사이에서 불평등하지 않은 합리적인 계약을 체결하는 데 기여할 수 있을 것으로 보인다. 또한 본 연구 결과가 국가 또는 공공기관 공연예술 분야에 대한 표준계약서를 마련하거나 개인 또는 단체가 공연과 관련한 계약서를 개발하거나 현행 계약서를 보완하는데 도움이 되기를 기대한다.

영문 초록

Since performing art is a combination of various arts and technical elements, there are many parties involved in producing performing arts with different roles, and various types of agreements are involved in the process. Many of the agreements reached over the course of the production are implicit or verbal, following industry practice. And even when a written agreement is signed, often it is not specific. The purpose of this study is to present a desirable model contract for use in producing performing arts, by taking a deeper look into different cases of contracts signed in the process of producing performing arts. It is also a goal to understand problems associated with consent forms or agreements made during production. For the purpose of this study, I classified contracts into 7 types; ‘Theater Rental Agreement’, ‘Copyright Agreement’, ‘Cast Agreement’, ‘Crew Agreement’, ‘Agent Agreement for Ticket Sales’, ‘Investment Agreement’, ‘Outsourcing Agreement’ based on our preliminary study and understanding of contract status in performing arts production. I reviewed 10 performing arts (musicals) that have been played for the for the five year period from 2007 to 2011, and analyzed details of the contracts according to type. The result of the study shows that different title, structure and number of provisions are used in the same type of contracts. And although there are same provisions, the level of details differ by type. Most of the contract conditions are favorable to the influential party. Overall, in comparison with other industry contracts, contracts in performance arts can be summed up and described as ‘having no general form,’ ‘not replaceable’, ‘not specific’, ‘unfair’ and ‘mutually related’. I believe that this study result underscores the importance of signing written agreements in production of performing arts, and specifying provisions of the agreements, which will eventually help all concerned parties of performing arts production to sign contract under equal and reasonable terms and conditions. Moreover, I hope this study helps to set a standard for agreements in performing arts of national or public institutions, and help individuals or groups to develop new agreements or supplements to the existing agreements.
