국문 초록

이 논문은 진술이 담긴 기계적 기록물에 대한 전문법칙 적용의 문제를 대법원 판례 사안을 중심으로 논하며 크게 두 가지의 주제를 다룬다. 하나는 전문법칙이 적용되는 진술 이란 무엇인가이고 다른 하나는 기계적 기록물에 대하여, 정확하게는 기계적 기록물의 기록과정의 정확성 담보 문제에 대하여 전문법칙이 적용되는가이다. 이 두 가지는 모두 제대로 규명되지 않으면 전문법칙 적용범위의 논의를 점점 더 복잡하게 만드는 원인이 된다. 이 논문은 위 두 가지의 연구주제를 규명하여, 종합적으로 기계적 기록물과 그 녹취서 등 여러 형태의 증거에 대하여 수미일관한 하나의 설명방법을 제시하고자 한다. 설명방법은 이 요약문에서는 생략하며, 연구의 결론은 논문의 본문에서 표로 나타내기로 한다.

영문 초록

This thesis deals with the subject of the Hearsay Exclusionary Rule related to mechanical evidence records. This thesis deals with two subjects; the one is to what kind of statement the Hearsay Exclusionary Rule should be applied, the other is the issue of whether the Hearsay Exclusionary Rule could be applied to the authenticity of mechanical evidence record or not. The statements that the Hearsay Exclusionary Rule to be applied are declarant s statements about his experience concerning the facts constituting a crime. And that means the statements to prove the truth of the matter asserted in the statement, too. If the statements itself were the fact constituting a crime, the statements have nothing to do with the Hearsay Exclusionary Rule. Provided that the statements recorded in a recording equipment(for example, magnetic tape, videotape, digital camera, smart phone, etc.) were the statements about the declarant s experiences concerning the facts constituting a crime, the Hearsay Exclusionary Rule could be applied to the authenticity of mechanical evidence record and transcripts of tape recording.
