미주지역 인권보장을 위한 미주인권사무국의 역할에 대한 소고

국문 초록

아시아헌법재판소연합 연구사무국의 설립과 운영은 향후 아시아인권체제의 설립을 위한 초석을 마련하고, 연구사무국의 연구가 우리 헌법재판소가 주도적인 역할을 하고 있는 아시 아헌법재판소연합 이사회에서 연구사무국의 기능 및 목표, 입지, 재원조달에 적극적인 지지를 하도록 비전을 제시하는 역할을 담당 할 수 있다. 연구사무국이 비록 아시아헌법재판소 연합의 기관이고, 헌법재판소의 직접적인 영향 하에 구성되고 운영되겠지만, 아시아인권보 장기구가 없는 현 시점에 각 국에 인권보호와 신장을 위한 자원을 제공할 뿐 아니라 이에 대한 부담을 줄 수 있는 실질적인 연구를 수행하는 것이 가능하도록 필요한 독립성과 자치 권한이 단계적으로 부여되도록 할 필요가 있다. 이러한 관점에서 다른 지역인권체제, 특히 미주지역의 인권보장기구의 연구를 담당하는 미주인권사무국의 기능 및 성과에 대한 고찰 이 궁극적으로 아시아지역의 인권보장 및 신장을 위하여 우리나라에 설치된 아시아헌법재 판소연합 연구사무국의 기능 및 역할을 위한 시사점을 제공한다. 지역적 인권보호체제의 설 립 뿐 아니라 효과적인 운영을 담보하기 위하여 그 지역 내에 각 국가의 인권보장과, 민주주의, 법치주의의 확립이 필요하다. 또한 인권보장을 위한 성숙한 시민사회의 역할이 필요 하다. 뿐만 아니라 제1세대 인권 뿐 아니라 제2세대 인권인 사회권의 보장을 위해서도 각 국가와 지역체제의 사회적, 경제적 기반이 요구된다. 따라서 연구사무국은 인권을 특정한 정치적 목적을 달성하기 위한 수단이 아닌 목적으로 하여, 궁극적으로 아시아지역의 인권체제의 설립과 보장을 위하여 또한 전 단계로서 인권의 개념 및 인권보호에 대한 합의점을 찾기 위하여 인권보호기구 뿐만 아니라 각 정부, 시민단체와의 연구, 교육, 교류를 통한 지속적인 노력을 경주해야 할 것이다

영문 초록

The establishment and successful management of research institute of Association of Asian Constitutional courts would provide foundation for the Asian Human Rights System in future. Moreover, the research of the institute will be able to prepare such visions for the Association of Asian Constitutional Courts(AACA), in which the Korean constitutional court takes an affirmative and leading role, that the Association should authorize and support the research institute with adequate mandate, goals, statue, and sources so that it may work out for building and encouraging Asian Human Rights System including the establishment of Asian Human Rights Court. Although the research institute is a branch of AACA and also will be organized and governed by the Korean Constitutional Court, it should be independent or autonomous enough institute to perform research and make meaningful research proposals and reports to encourage human rights protections in each country, to provide necessary education and training, and to make accountable the persons and governments who are in charge of human rights protection, or those who violate human rights in Asian countries, for the time being as there is no organization for human rights in Asia. From this point of view, this article takes a serious consideration of the human rights system in other regions, in particular, the Inter-American Institute of Human rights, which is the institute charged with functions and responsibilities of researching and educating human rights and human rights system. Accordingly, it would contribute to give guidance for the functions and mandates of the research institute of the AACA in Korea that will eventually become a cornerstone for building Asian Human Rights System.
