국문 초록

연구목적: 본 연구의 목적은 다음과 같다. 첫째, 향후 국내기업이 국제적 전자상거래에서 발생할 수 있는 분쟁들을 해결하기 위해 EU의 ODR 규정을 검토한다. 둘째, 동 규정을 토대로 분쟁해결의 대안을 모색한다. 셋째, 국제 전자상거래에 대한 원만한 분쟁해결방안을 제시하여 동 거래의 효율성을 증대시킨다. 논문구성/논리: 본 연구에서는 먼저, 국경 간 전자상거래에 대한 개념과 ODR의 일반적 고찰 및 과 ADR과 비교 등을 살펴보고, 이어, 국내 ODR 제도 등을 살펴보고, EU ODR 규정을 검토ㆍ분석하고, 결론에서는 유럽 ODR 규정을 통한 시사점을 제시한다. 결과: 2016년 EU ODR 플랫폼을 창설되어 소비자와 사업자에게 서비스를 개시하였다. EU ODR 플랫폼은 소비자들의 ADR 절차에의 접근가능성을 제고하여 소액분쟁에서의 피해 구제 가능성을 높였다는 점에서 큰 의의를 가진다. 따라서 본 논문은 국내기업이 EU와의 전자상거래에서 발생할 수 있는 분쟁을 ODR 플랫폼을 활용하여 해결하는 방안을 제시하고 있다. 이는 결과적으로 국내기업의 EU에서의 경쟁력을 향상시킬 수 있다. 독창성/가치: EU의 ODR과 관련된 입법 동향과 EU ODR 플랫폼의 설립은 우리 기업의 유럽 내에서의 영업과 관련하여 중요한 의미를 가진다. EU에서 영업하는 우리기업이 EU ODR 규정의 적용 가능성 및 EU ODR 플랫폼을 통한 분쟁해결 절차에 관한 내용을 검토하는데 유용할 것이다. 또한 국내 전자상거래에 있어 소비자의 분쟁해결기관에의 접근성을 제고하여 소비자보호 등에 관련된 유용한 자료로 활용될 것으로 여겨진다.

영문 초록

Purpose: First, this study reviews the Online Dispute Resolution (ODR) regulations of the EU, designed to help resolve disputes in international e-commerce. Second, it identifies alternative solutions to the dispute resolutions based on these regulations. Third, the study attempts to increase transaction efficiency by proposing effective dispute resolution methods for international e-commerce. Composition/Logic: First, this study reviews the concept of cross-border e-commerce, explores ODR, and compares it with Alternative Dispute Resolution (ADR). Then, the study examines the domestic ODR system and analyzes the EU’s ODR regulations. The study finally discusses the implications of European ODR regulations. Findings: The EU ODR platform has greatly facilitated the settlement of small disputes by enhancing consumers’ accessibility to ADR procedures. Therefore, this study proposes a method by which Korean companies may resolve e-commerce disputes with the EU using the ODR platform, which is expected to increase the competitiveness of Korean companies in the EU market. Originality/Value: Legislative trends related to the EU’s ODR and the establishment of the EU ODR platform have significant implications for Korean businesses operating in Europe. This study’s review of the applicability of the EU’s ODR regulations and the EU ODR platform’s dispute settlement procedures should be useful to Korean businesses operating in the EU. The study should also advance consumer protection by enhancing consumers’ accessibility to dispute settlement institutions in domestic electronic commerce.
