최근의 위치정보에 관한 논의, 그리고 그 평가와 시사

국문 초록

최근 스마트폰으로 대표되는 각종 태블릿PC(Tablet PC)의 등장과 이를 통한 페이스북ㆍ트위터 등 새로운 패러다임의 정보통신방법이 가능하게 되면서 우리들의 소통공간은 글자 그대로 일상의 혁명을 맞이하고 있다. 그러나 유비쿼터스센 서네트워크(USN)의 진척에 기여하는 스마트폰 등 다양한 휴대용단말기들의 출현과 그 활용방법의 변혁은 시간과 공간을 초월한 쇼셜네트워크(SNS)의 확대라는 긍정적인 측면이 있는 반면에, 여기에 이용되는 기술들은 한결같이 사람과 사물 의 이동성(mobility)을 추적하여 특정한 대상에 대한 위치정보(location data)를 파악하게 됨으로써 위치프라이버시 혹은 개인정보의 침해에 대한 우려문제의 해결과제가 있다는 점이다. 현실적으로 미국의 경우에 각종 태블릿PC와 위치정보프 로그램을 개발하고 판매하는 국제적 기업인 애플과 구글사를 상대로 미국의 국내는 물론 약 30여개국에서 위치정보침해를 이유로 현재 대규모 집단소송이 진행 중인 상황이며, 최근 국내에서도 애플사를 상대로 한 “아이폰 위치정보수집 집단소송”이 제기되었다. 본 논문에서는 이와 같은 최근의 “손안의 PC”시대라는 새로운 정보환경에 수반한 위치정보침해의 위험성에 주목하여, 우리보다 선진적인 미국을 모델로 하여 정보통신기술혁신에 따른 합헌성의 해석기준, 관련법령, 최근 연방의회의 위치정 보의 보호와 규제를 목적으로 한 관련법제정비의 시도 등을 소개ㆍ분석한다. 그리고 이 논문에서는 미국의 사례를 우리나라 법제의 관점에서 평가하고, 이에 기초하여 향후 우리나라 경우 법원의 위치정보에 관한 사법심사의 해석기준과 법제개편의 방향성에 관한 시사점을 발견하려는 데 초점을 두었다.

영문 초록

In recent years, the space to communicate among us literally has welcomed the revolution of the daily life since the way to communicate on information network system with new paradigm like the Facebook, Twitter and or so has been available with the appearance of tablet PC including smartphone. However, while the appearance of smartphone and other mobile devices contributing to the advance of the ubiquitous network society(hereinafter referred to as “UNS”) and the change of the way to use of themselves have the advantage of the expansion of social network system(hereinafter referred to as “SNS”), there is a difficult task to resolve the possibility to infringe the privacy on location data of a specific person by collecting and using location data where someone or something has been. Actually, the class action against Apple Inc. and Google Inc. which have developed and sold tablet PC or its operating system including location based program has been pending in the US and other thirty countries. This thesis introduces and analyzes a latest discussion on location information in the US, dealing with the standard to construe constitutionality by the renovation of information technology, the laws and the situation for the congress to try revising and establishing laws to protect and regulate location data under the US model through focusing on the risk of the privacy infringement on the location information accompanying with new information environment under the emerging hand-held PC. Besides, it also has a purpose to find the suggestion by evaluating the discussion in the US in the viewpoint of Korean laws.
