국문 초록

중국에서 변호사조정(律師調整)제도란 소송절차가 시작하기 전에 소송을 통하지 않고 분쟁을 해결 방법 중 하나로서(ADR), 현재 중국에서 주목 받고 있는 민간조정제도중의 하나이다. 본제도의 선진국에서의 발전상황를 보면 우월성과 전통을 지니고 있다. 한국에서는 변호사조정제도에 대한 연구가 아직 많지 않기 때문에 이하에서는 중국에서의 변호사조정제도의 최근의 발전상황을 소개하고자 한다. 본고는 중국에서의 변호사조정제도의 현황과 문제점 가능성 등과 관련해서 서술하고 있는바, 변호사 조정을 받는 사건들은 매우 복잡하게 전개되는데, 이는 상업적으로 관련된 사건 뿐만 아니라, 친족, 이웃갈등, 상속 등 다양한분야에서 중국에서의 전통적인 민사분쟁사건들을 다수 포함 하고 있다. 현재 중국의 변호사조정제도가 발전 가능한 것은 바로 각 변호사사무소나 변호사협회에서 주관하는 조정기관(센터)에서 다루기 때문으로 보인다. 결국 중국에서의 변호사조정제도는 효율적으로 인민조정, 행정조정, 사법조정 등과 서로 조화를 이루면서 중국특유의 사회분쟁 해결방식으로 자리를 잡을 것으로 사료된다.

영문 초록

The lawyer’s mediation system is a new folk mediation method in China that is burgeoning and becoming mature gradually. Based on the experience in western countries, we believe that this mediation method is full of superiority and vitality. Since there is little research made in this field, I intend to introduce the new development of this folk mediation method in China in detail, including its status quo, obstruction, feasibility and so on. The lawyer’s mediation system shall not only solve the professional and complicated commercial issues but also those issues relating to marriage, neighborhood, heritage and other civil cases. From my perspective, the best way to develop the lawyer’s mediation system is to establish specialized mediation department which is leaded by certain government authority or Bar Association. The lawyer’s mediation system shall corporate with people’s mediation, administrative mediation and judicial mediation forming an effective dispute-settlement method with Chinese characters. The lawyer’s mediation system must develop well with strong vitality.
