알코올중독과 상습폭력의 이중고를 겪는 가정을 위한 국가지원체계 현황과 발전방향 모색

국문 초록

음주와 폭력을 허용하는 인식과 사회문화 탓에 끊임없이 관련 사고가 발생하고 있다. 알코올중독이 성인의 12% 이상이고, 가정폭력 신고는 매년 20만 건이 넘을 정도이다. 하지만 실제 비율은 훨씬 더 높을 것이 라고 짐작할 수 있다. 왜냐하면 부부폭력 시 도움을 요청한 비율이 1% 에 불과하고, 그 가운데에서 경찰, 여성긴급전화 1366, 가정폭력상담소 및 보호시설/쉼터에 도움을 요청한 비율이 3% 미만이기 때문이다. 이처럼 음주와 폭력 사건은 마치 일상처럼 우리 사회에 자리하고 있다. 음주를 동반한 폭력은 비 음주 상태의 폭력보다 강도는 더 세고 빈도 는 더 잦다. 이러한 음주와 폭력이 가정 안에서 동시에 발생할 때, 특히 알코올중독과 상습폭력의 이중고를 겪을 때, 가족구성원 모두 에게 치명적 상처와 아픔을 남기게 되고, 생명권의 침해에 이르는 극단적 사태를 불러오기도 한다. 따라서 알코올중독과 가정폭력이라 는 각각의 국가지원체계와 더불어, 이 두 가지 문제를 동시에 겪으면서 가장 심각한 문제에 시달리고 있는 위기가정을 위한 국가의 통합지원체계의 구축이 정말 꼭 필요하다. 2017년 5월 기준으로 알코올중독은 보건복지부, 가정폭력은 여성가족 부에서 담당하고 있다. 알코올중독과 가정폭력 둘 중 하나의 문제만을 가진 이들도 있겠지만, 적지 않은 이들이 이 두 가지 문제점을 동시에 갖고 있기 때문에, 본고는 음주와 폭력을 각각의 영역에서 바라보고 대 처하는 국가지원체계의 문제점에서 출발한다. 따라서 본고는 무엇보다도 먼저 음주와 폭력의 상관관계와 관련한 많은 연구의 결과들을 제시 하면서, 음주와 폭력, 특히 알코올중독과 가정폭력이 별개의 문제가 아니라 서로 연결되는 문제라는 사실을 적시하였다. 이어 알코올중독과 가정폭력을 별개의 문제로 여기는 탓에 실태조사 역시 각각 이루어지지 만, 가능한 범위 내에서 알코올중독과 가정폭력의 실태를 점검하면서 연결되는 부분들을 찾아보았다. 이를 기초로 본고는 알코올중독과 가정폭력의 이중고를 겪고 있는 위 기가정을 위한 국가지원체계 현황을 점검하면서, 원스톱통합지원체계의 구축, 긴급임시조치, 피해자 임시보호명령제도, 신변안전조치의 신속처리와 강화, 영구 피해자보호명령 제도 도입 등 수사적, 법적 제도 강화 와 개선, 위기가정 지원서비스 강화, 음주와 폭력 두 가지 문제에 최적 화된 관련 시설과 치료 프로그램 개발, 음주와 폭력 허용적 인식과 사회문화 개선을 위한 교육과 홍보 등 그 발전방안을 제시하였다.

영문 초록

The perception and social culture allowing alcohol and violence have constantly caused numerous accidents. Alcohol addiction is more than 12% of entire adult populations and reports on domestic violence have appeared to be more than 200,000 cases every year. However, it is assumed that the actual rate will be much higher. Since only 1% has requested assistance in entire marital violence cases, among which the ratio of requests for assistance to police, women emergency call 1366, counseling center and protection facility for domestic violence is less than 3%. Likewise, alcohol and violent incidents happen as usual in our society. The alcohol-related violence is more intense and frequent than non-alcoholic violence. If alcohol consumption and violence occur simultaneously at home, especially when accompanied by alcohol intoxication and habitual violence, catastrophic injuries and pain to all family members naturally ensue, and extreme situations leading to transgression of right to live may transpire. Consequently, along with the state support system for alcohol intoxication and domestic violence, it is indispensable to establish an integrated national support system for the family in crisis, the family suffering from the ramifications of alcohol intoxication and domestic violence. As of May 2017, the alcohol intoxication is handled by the Ministry of Health and Welfare, and domestic violence by the Ministry of Gender Equality and Family. Although there may be people who have only one problem either of alcohol intoxication or of domestic violence, majority of them have aforementioned two problems at the same time, a sufficient reason for this paper to start with the problems of the state support system coping with alcohol and violence in its respective domains. First of all, this paper presents the results of many researches displaying correlation between alcohol consumption and violence, and suggests that alcohol consumption and violence, especially alcohol intoxication and domestic violence, are not separate but rather connected to each other. As alcohol intoxication and domestic violence are regarded as separate issues and thus current situation surveys have been conducted separately, we attempted to scrutinize the actual situation and search for connections between alcohol intoxication and domestic violence within the widest possible range. Accordingly, this paper has examined the current state of the national support system for families in crisis suffering from alcohol intoxication and domestic violence, and has suggested strengthening and improving the rhetorical and legal system such as creation of the development plan focused on the establishment of a one-stop integrated support system, urgent interim measures, temporary protection measure for victims, timely treatment and reinforcement of personal safety measures, and introduction of permanent protection order system for victims, strengthening of support service for families in crisis, developing the facilities and treatment programs optimized for problems arise from alcohol and from violence, promoting education and publicity for the improvement of perception that allows conniving and for social culture of alcohol and violence.
