중국 토지법제의 이원화에 관한 연구

국문 초록

중국 도시와 농촌의 토지법제의 이원화는 도시와 농촌의 호적을 구별해서 도시와 농촌 간에 생긴 장벽으로 표현하고 있는 토지에 관한 문제이다. 2002년 중국공산당 제16차 대표대회에서 도시와 농촌을 통일적ㆍ전면적으로 발전시키는 “경제사회의 발전방안”이 제출되었고 2007년 공산당 제17차 대표대회에 이르기까지 강조되었다. 당국은 도시와 농촌의 현황에 따라 발전의 불평등을 개선하기 위해서 노력했지만 오랫동안 형성된 발전의 국한성 때문에 개선이 제대로 이루어지지 못하고 있다. 2013년 중국공산당 제18기 중앙위원회 제3차 전체회의에서는 “도시와 농촌 일체화의 발전체계”가 제출되어 도시와 농촌의 자원이 공평하게 교환ㆍ이용되어 함께 발전할 수 있도록 계획되었지만 이는 토지법제의 이원화에 의해 실현되지 못하고 있다. 도시와 농촌의 토지법제의 이원화는 단순한 토지법제의 결점이 아니라 사회자원의 정치적 분배에 따라 각종의 불공평한 현상과 농촌 토지제도의 결점 등 여러 가지 요인이 있는 복잡한 문제이다. 이러한 역사적으로 남아 있는 문제는 토지법제의 각 방면에서 표현되어 농촌의 개발, 농업의 발전과 농민들의 권리를 침해되었다. 중국 토지법제의 이원화는 도시와 농촌의 일체화, 특히 농촌경제의 발전에 가장 큰 장애가 되고 있다. 정부의 실책, 도시화의 비정상적인 발전, 농촌토지시장의 제한, 토지수용에 따른 농민의 권익에 대한 침해 등의 문제점이 드러남에 따라 농촌경제의 발전과 농민들의 권익을 보호하기 위하여 본 연구에서는 토지법제의 이원화에 대한 개선방안을 모색하였다.

영문 초록

In 2002, the 16th Representative Congress of Chinese Communist Party (CCP) firstly put forward Urban and Rural Harmonious Development Programs of Economic Society and re-emphasized in the 17th Representative Congress of CCP in 2007 which further proposed the new pattern of Urban-Rural Integration. Despite the efforts under the current situation of urban and rural development, urban and rural areas did not get much change because of the limitations it has long been formed. In 2013, the 18th Central Committee of CCP proposed perfecting the development of Urban-Rural Integration on its Third Plenary Session, which intended to an equal exchange by using urban and rural resources to achieve their common development and prosperity. But this series of plans were hardly realized because of the dualization of land system. The dualization of Chinese land system is the biggest obstacle to the Urban-Rural Integration, especially in the rural economic development. In order to promote the development of rural economy and protect farmers rights and interests under the exposure of the problems such as the default of government, abnormal development of urbanization, defects of the rural land market and the damage of farmers rights and interests caused by land expropriation, this paper will put forward relevant proposals for the reform according to the problems of the dualization of urban and rural land system.
