국문 초록

최근 서울 강남 서초동 한 노래방 화장실 살인사건, 미국에서의 무슬림에 대한 범죄, 영국의 이민자에 대한 범죄 등 많은 사건들이 벌어지고 있다. 이 범죄들은 누군가에 대해서 미움, 증오, 편견, 혐오 등으로 발생한 범죄이다. 이런 범죄의 피해자는 대부분 가해자를 모른다는 점이다. 과거 범죄는 피해자는 가해자를 알고 있는 경우가 대부분이었다. 범죄 피해자가 특정되지 않고 누군가를 미워하고 증오하며 일어난 범죄가 증오 범죄이다. 사회가 발전 하면 할수록 증오범죄는 다양화 될 것으로 생각된다. 증오범죄에 대한 명확한 정의가 필요로 하며, 범죄피해자에 대한 관심과 범죄자에 대한 적절한 교화가 필요한 시점이다. 증오범죄는 선천적ㆍ심리적 원인, 가정적 구조의 역할과 구조문제, 폭력문제 등 다양한 원인으로 발생하고 있다. 따라서 이들 범죄자에 대한 대응방안을 모색하는 데는 많은 어려움에 봉착할 수밖에 없을 것이다. 증오범죄의 피해자는 가해자가 누구인지도 모른 상태에서 피해가 발생하고 있으므로 입법, 사법, 행정 모든 분야에서 통합적 지원이 될 수 있도록 해야 한다. 그리고 가해자에 대해서는 자유억제와 동시에 지정행요법, 현실요법, 심리극, 사회요법 등을 통해 최대한 치료 중심의 교정역할이 이루어져야 할 것이다. 이를 위해서는 증오범죄특별법을 만들어 정부의 지원 아래 피해자에 대한 지원 방안의 모색과 가해자에 대한 치료가 이루어질 수 있도록 해야만 증오범죄를 줄일 수 있을 것이다.

영문 초록
