맥코믹의 규칙 이론에 대한 고찰 : 규칙 삼분론과 규칙의 실천력

국문 초록

맥코믹(Neill MacCormick) 1) 은 ‘제도적 법이론(An institutional theory of law)’ 의 주창자 2) 로서 ‘제도적 법실증주의(Institutional positivism)’를 제창함으로써 법실증주의의 분화와 다변화에 큰 기여를 했다고 평가된다. 맥코믹의 여러 연구 성과와 세계 법철학계에서의 영향력에도 불구하고, 안타깝게도 국내에서는 그의 연구 성과가 거의 소개되지 못했다. 3) 맥코믹은 법에 대한 제도적 접근을 주장하면서, 법의 본성에 관한 새로운 통찰을 제시하고 일반 이론을 정립한다. 맥코믹의 ‘규칙 이론’은 일반 법이론으로서 제도적 법이론 전반에 걸쳐 핵심적인 분석적 기초를 제공한다. 이러한 중요성에도 불구하고, 맥코믹 스스로 규칙 이론을 별도의 독립된 주제로 다루지는 못했다. 4) 하지만 그 특별한 가치와 영향력이 적지 않기에, 본고는 규칙에 관한 맥코믹의 이론적 성과를 ‘맥코믹의 규칙 이론’ 이라는 제목 하에 체계적으로 고찰하고자 한다. 본고에서 다루는 맥코믹의 규칙 이론은 주제적 측면에서 보면 크게 두 부분으로 구성된다. 첫째는 성립 규칙・결과 규칙・종결 규칙에 관한 이론(이하 ‘규칙 삼분론’으로 약칭함.)이다. 이는 개념적 차원의 논의이며 ‘법적 제도 (legal institution)’의 필수적인 개념소(槪念素)다. 둘째는, 규칙의 적용 방식을세 가지로 유형화-절대 적용, 엄격 적용, 자유재량적 적용-함으로써 규칙의 실천적 힘(practical force, 이하 ‘실천력’으로 약칭함.)을 규명한 이론이다(이하 ‘규칙 적용론’으로 약칭함.). ‘규칙 적용론’은 법실무에서 규칙의 실천력이 구현되는 방식과 실제를 이론적으로 해명하고 분석한다. 맥코믹의 규칙 이론에 대한 충실한 이해와 재구성, 그리고 비판적 검토를 목표로 본고는 다음과 같이 구성된다. 우선 맥코믹의 규칙 이론이 성립되게된 배경을 ‘법이론사적 기원’과 ‘철학적 기초’를 중심으로 살펴본다(Ⅱ). 그리고 맥코믹의 규칙 이론을 개관한 후에, 구체적으로는 ‘규칙 삼분론’(Ⅲ)과 ‘규칙 적용론’(Ⅳ)으로 체계화하여 다각도로 고찰한다. 특히, 이론에 대한 평면적 소개를 넘어 그 의의와 한계도 함께 논한다. 마지막으로 맥코믹의 규칙 이론의 공과를 전반적으로 평가하면서 글을 맺는다.(Ⅴ)

영문 초록

This article examines from multiple perspectives and in depth the ‘Rule Theory’ of Neil MacCormick, a renowned advocator the Institutional Theory of Law. MacCormick’s Rule Theory not only served as an essential analytical basis throughout his Institutional Theory of Law, but also contributed greatly to the theoretical history of analytic jurisprudence itself, providing us with a significant insight for the legal theory and legal practice today. This article examines the theory from the perspective of its ‘trichotomy of rules’ and ‘theory on the application of rules’. By the ‘trichotomy of rules’ he classifies rules as ‘institutive’, ‘consequential’ and ‘terminative’ rules, based on the unique function of each kind. As an argument on a conceptual level, it is an essential part of ‘legal institutions’. In his theory on the application of rules, MacCormick distinguishes between ‘absolute’, ‘strict’, and ‘discretionary’ application, so as to elucidate the practical force of rules. With this he theorizes and analyses how the practical force of rules is actually realized. And thus the relation between rules and principles, as well as that between values and standards, is organized in a systematic way. With an aim to thoroughly understand and reconstruct MacCormick’s Rule Theory, and for a critical review thereof, this article proceeds as follows :examines the background of the emergence of the theory, centering on its origins in the history of legal theory and its philosophical basis (II). The theory is an attempt to overcome the problems of H.L.A. Hart’s Rule Theory, which succeeds with improvements John Searle’s theory on constitutive rules; Based on the thorough understanding of the intellectual origins of MacCormick’s theory, we shall examine the theory from the point of its ‘trichotomy of rules’ (III) and ‘the theory on application of rules’ (IV), each from multiple perspectives; Lastly, we shall conclude the article with a general evaluation of the merits and demerits of the theory (V).
