국문 초록

최근 민간경비 산업이 크게 성장하는 배경에는 이들 산업에 대한 정부주도의 보다 전문적이고 능동적인 규제 관리와 선제적 개입도 큰 몫을 차지하고 있다. 민간경비 산업의 건전성을 제고하기 위한 대안 모색의 유용한 방법은 여러가지가 존재하며, 주요 선진국이 운영하는 현행 제도상의 이점을 검토하여 시사점을 찾고, 이를 우리 현실에 적용하는 혁신 모델 벤치마킹 기법은 그 주요한방법 중의 하나이다. 이에 본 연구에서는 호주에서 2008년부터 호주정부협의회(COAG)가 중심이 되어 민간경비산업의 공공성과 공신력 확보를 담보하기 위해 도입하여 운영해오고 있는 선제적 규제기법들과 그 실증적인 운영 방법론을 분석하여 규제 유인수단에 관한 6개 항목의 가이드라인을 제시함으로써 국내제도에 참고할만한 시사점을 도출하였다. 연구결과, 호주의 민간경비산업 관리･운영은 기본적인 신원검사 및 소양심사 외에 보다 강화된 결격사유조회 업무의 이행(해외 범죄경력ㆍ신원조회), 사고위험이 있는 인력의 이상 징후 조기 식별체계의 구축, 업무수행에 영향을 미칠 수 있는 금지약물 투여ㆍ주취상태 여부에 관한 수시점검 및 면허소지자에 대한 실시간(real-time) 모니터링의 강화(범죄, 사건사고, 신고 현황), 위험집단과의 공모가 의심되는 인원에 대한 프로파일링 및 정보활동(intelligence)의 확대 및 자유재량에 의한 면허취소･영업정지 처분의 확대 등 조기감지와 조기개입 프로그램의 점진적 확대 도입을 특징으로 하였다. 이와 같은 호주의 선행사례를 주의 깊게 참조하여 국내에서도 적극적인 제도정비 개선노력과 제반 소요비용에 대한 배부기준의 검토를 통해 능동적인 예방진단체계의 구축과 사전억지에 초점을 맞춘 다각적인 연구와 실천을 강화하여 민간경비산업 전반의 경쟁력 향상을 도모하는 것이 바람직할 것으로 평가된다.

영문 초록

The security industry is thriving in size and scale. This expansion emphasizes the need for more advanced government-sponsored strategies to proactively monitor compliance and mitigate industryspecific risks. To translate these strategic objectives, a critical step in the process requires a comprehensive recognition of a system of regulation and oversight abroad that allow for effective benchmarking of best practices. The aim of this article is to present a compilation of cross-licensing arrangements that exist across Australia, and set out the main parameters of COAG-led proactive intervention programs put in place or under active discussion for regulatory purposes since 2008. This inquiry is engaged by assessing the core and expanded programs, defining the 6 sets of valuable guideline on regulatory techniques and add-on features that would provide valuable lessons in regulation relative to South Korea. Overall, this study has surveyed some key salient features of Australian regime that extend beyond the background and character checks, markedly overseas police clearance requirement; restrictions to licenses based upon close associates of declared organization; early detection of unsuitable operatives supported by fitness for work policy; spot-check drug and alcohol testing program; wider application of real-time crime/incident log checking across the licence intelligence capabilities; and the expanded grounds for automatic disqualifying criteria, including discretionary disqualification. A survey of the Australian regulatory regime demonstrated that reasonable precautions have been taken to address conduct problems with the emergence of a more early intervention strategies, and that the overall lessons learnt from the Australian case demonstrates a strong case for more compliance-driven, and proactive monitoringbased regime in South Korea with additional funding commitment.
