국문 초록

｢헌법｣은 국민의 기본권을 보장하는 가장 중요하고도 핵심적인 상위법률체계라고 말 할 수 있다. ｢헌법｣에 규정된 국민의 기본권은 제37조 제2항을 통해서 국가안전보장, 질서유지, 공공복리를 위한 경우에만법률로서 국민의 기본권을 제한할 수 있도록 하고 있다. 그러나 국민들이 사회생활을 영위하기 위해 필요한 기본적 권리는 법률에 의해서도 제한할 수 없도록 명문화하고 있다. 이러한 기본권 중 국민의 생존권과 관련된 것이 바로 노동권이라고 할 수 있다. 이러한 노동권은 노동3권을 핵심요소로 한다. 즉, 단결권,단체교섭권, 단체행동권을 말한다. 이러한 노동권의 보호는 사용자와 노동자간에 형성되는 주종관계에서 중요한 역할을 담당한다. 따라서 청원주와 청원경찰에 의한 노동자의 노동권 침해는 헌법상명문화하고 있는 노동자의 생존권을 박탈하는 것과 같은 결과를 도출해 낼 수 있다. 그러므로 노동자의 노동권을 보호하기 위한 청원주와청원경찰의 노력이 요구되고, 특히 청원경찰법개정법률(안)을 통해 청원주와 청원경찰이 노동자의 기본권을 침해하지 못하도록 하는 개정법률의 방향 제시가 필수적이라 할 수 있다.

영문 초록

The constitutional law can be said as the most important and the highest core law system to secure natural right of the people. The right regulated by the constitutional law is able to be limited by laws only in the cases of national security, maintenance of order and welfare of the public through Article 37 paragraph 2. However the basic human right for the people to survive socially is regulated not to be limited by laws. The important thing related in the right to life among these natural rights is labor rights. These labor rights have core parts which are called as three labor rights. These are the right to organize, the right to bargain collectively and the right of collective action. Prevention of these labor rights has an important role in the relation between employer and employees. Therefore infringement of labor rights by the owner and the employees of security guard can be resulted in deprivation of the right to life for workers which is regulated in the constitutional law. Accordingly the owner and the employees of security guard are required to prevent labor rights for other employees, and particularly the direction guidance of an amendment to the Act is necessary not to infringe on the natural rights of workers by the owner and the employees of security guard through bill amending the Registered Security Guard Act.
