국문 초록

고전적 국제법이론에 의하면 개인은 국제법의 객체로 파악되었을 뿐이며 국제법의 유일한 주체는 국가였지만 20세기 특히 제2차 세계대전 후 국제법체제의 전개와 점진적 발전은 국제법규의 형성과정에서 인도주의적 가치의 중요성을 인정하는 데 있어서 상당한 진척을 이룸으로써 개인의 국제법주체성 내지 국제법인격을 인정하는 학자들이 증가하게 되었다. 이 글은 20세기에 찾아온 개인의 국제법인격에 대한 인식의 변화에 기초를 하면서 21세기를 맞이하여 개인의 국제법인격에 대한 국제법이론의 발전을 재조명하여 국제법상 능동적 지위를 보유하고 있는 개인의 법적 지위와 국제법인격의 성격을 분명히하고자 하는 데 일차적 목표를 두고 있다. 논의의 구체성과 명확성을 높이기 위해 논의의 대상은 개인 중에서 자연인에 한정하고자 하며 국제법인격 부여의 전제요건으로 많은 저서에서 가장 중요하게 인식되고 있는 국제청구능력에 대한 분석에 집중하고자 한다.

영문 초록

According to the theory of traditional international law, individuals have been considered nothing but the object of international law and States as being the sole subject of international law. The progressive development of international law since the World War II, however, has made noticeable development in recognising humanitarian values in the process of the formation of international legal norms. As a necessary consequence, numerous authors have recognised the international personality of individuals. Based on the fundamental change of the perception of their international personality, this article reassesses the development of the international law theory on international personality of the 21st century and is to clarify the legal position of individuals with personality under international law. For the argument s sake, the author will focus mainly on the personality of natural person rather than that of corporate - juridical person, and analyse his or her capacity to bring international claims that has been considered most important one of the requirements for conferring international personality on certain entities.
