국제법의 국내적용에 관한 한국의 법체계와 경험

국문 초록

대한민국헌법 제6조제1항은 국제법과 국내법의 관계에서 우리나라 법체계가 일원론을 취하고 있다고 일반적으로 받아들여지고 있다. 그리하여 우리나라가 비준⋅가입한 조약은 국내법상의 공포절차를 거치면 별도의 절차 없이 그 자체로서 공식적인 효력을 갖는 국내법의 일부가 되어 국내법원에 의해 적용될 수 있다. 국제관습법 역시 특별한 수용절차가 요구되지 않는다. 이와 같은 법체계 하에서 국제법의 국내적용 문제는 중요한 사법적 현안으로 부상하였고 우리나라 국내 법원은 국제법의 국내적용에 관한 경험이 상당 정도 누적되었다. 우리 법원이 국제법의 국내적용 문제를 다루는 태도는 분야별로 다르다. 인권 분야에서는 국제법의 국내적용에 매우 소극적이지만, 다른 분야, 특히 통상 분야에서는 매우 적극적이다. 현상적으로는 우리 법원이 이중기준을 적용하는 것이지만, 본질적으로 국제법의 국내적용, 특히 직접적용에 의해 국내법체계의 사법적 혁신이 일어나는 것을 피하고자 하는 사법소극주의의 결과이다. 출신에서 외래적인 국제법의 국내적용에 의해 국회의 입법권을 침해하지 않으려고 하고, 대외관계 수행의 우선적 지위를 갖는 행정부를 곤혹스럽게 만들지 않으려는 수동적 삼권분립주의를 지향하는 우리법원의 사법적 소극성(judicial timidity)은 헌법상 권력분립원리를 위태롭게 할 수 있다. 우리 법원의 공정한 균형이 요구된다. 우리 법원이 공정한 균형을 취하는 방안의 하나로 부상하는 것은 국내법의 국제법합치해석을 통한 국제법의 간접적용이다. 간접적용 방식은 변화를 요구하는 법현실을 반영하면서도 국내법체계의 안정성을 파괴하지 않고 국제법을 받아들일 수 있는 장치이다. 특히 간접적용방식은 법형식적 효력을 갖지 않은 국제법의 국내적용도 보장한다. 또한 국제법의 직접적용에 의해 야기될 수 있는 사법적 위험을 피하거나 줄일 수 있는 방안이기도 하다. 이제 우리 법원이 국제법의 간접적용 활성화를 진지하게 그리고 적극적으로 모색할 때이다.

영문 초록

Article 6 Paragraph 1 of the Constitution of the Republic of Korea has been widely recognized as(a piece of) evidence showing that the Korean legal system adopts a monistic approach in terms of the relationship between domestic law and international law. Accordingly, a treaty may automatically become part of the domestic law without legislation once it has been concluded in accordance with the Constitution and promulgated pursuant to the domestic legal procedures. Under such a legal system, cases relating to domestic application of international law in Korean courts have increased in number since 1990s. Therefore, accumulated judgements of the courts demonstrate their attitude and criterion of applying rules of international law. The courts take a very passive stance in considering matters of human rights while they become proactive in considering matters of international trade. On the face, the courts may appear as if they are applying double standards. In essence, however, this is the outcome of judicial passiveness of the courts which want not to innovate the Korea s national legal order as a result of domestic application of international law. The courts are afraid that their judgements might interfere with the legislative power of the National Assembly. Also, the courts are prepared to respect the Executive s preference of foreign relations. Such judicial timidity of the Korean courts can undermine the separation of powers enshrined in the Constitution. The courts need to stand in balance in an fair way. It might be suggested that the indirect application of international law, which applies rules of national law in consistence with rules of international law, is a useful tool for attaining such an fair stance. The method of the indirect application could serve as a guarantee for complying with international law without disturbing the stability of the domestic legal order while effectively reflecting the socio-legal demands which calls for changes. Moreover, it could facilitate the domestic application of international law that is yet to obtain the legal effect in the formalistic sense. It is also useful in that it could avoid or reduce the judicial risks usually caused by the direct application of international law. It is expected that the courts actively adopt the indirect application of international law.
