국문 초록

현행 프랑스 헌법 전문은 “전통에 충실한 프랑스 공화국은 국제공법규칙을 준수한다”라고 명시하여 국제법 존중원칙을 천명하고 있다. 조약의 국내법상 위계질서에 관해서는 헌법 제55조에 “적법하게 비준 또는 승인된 조약이나 협정은 각 협정이나 조약이 다른 당사국에 의하여 시행될 것을 조건으로 하여 공포시로부터 법률에 우선하는 권위를 가진다”고 하여 헌법보다 하위이지만 법률보다 상위임을 밝히고 있으며, 국내이행상 상호주의를 전제조건으로 제시하고 있다. 그러나 국제관습법의 경우 명문규정이 없어 과연 조약과 마찬가지의 대우를 받고 있는지에 대한 의문이 제기되어 왔다. 프랑스는 국사원(Conseil d Etat)으로 대표되는 행정법원, 파기원(Cour de cassation)으로 대표되는 사법법원 그리고 헌법수호를 위한 헌법위원회(Conseil constitutionnel)가 각각 국제법의 국내적용에 관한 판단을 독자적으로 행하고 있어 국제법과 국내법 양자관계에 관한 복잡한 구도를 형성하고 있다. 현재 이세 기관은 모두 조약의 법률에 대한 우위를 인정하고 있다고 보여지지만, 헌법에 명문규정이 없는 국제관습법의 경우 아직까지 명확한 입장정리를 할 수 없다.

영문 초록

Current Constitution of the Republic of France announces its solemn respect towards to the rules of public international law in its Preamble as follows: “La République française, fidèle à ses traditions, se conforme aux règles du droit public international.” Concerning the hierarchy of international treaties in French domestic legal order, the French Constitution proclaims the superiority of treaties to French domestic laws and a pre-condition of reciprocity for the implementation of international treaties. Article 55 says that “Les traités ou accords régulièrement ratifiés ou approuvés ont, dès leur publication, une autorité supérieure à celle des lois, sous réserve, pour chaque accord ou traités, de son application par l autre partie.” However, there is no explicit clause concerning the international customary law so the questions were put whether the latter could profit the same legal appreciation as international treaties in the French domestic legal order. In France, the implementation of international law, i.e. treaties and international customary law, is treated independently and separately by administrative tribunals(its head - Conseil d Etat), judicial bodies(its head - Cour de cassation) and Council of Constitution.(in French, Conseil constitutionnel) These principal organs all accept after long trials and errors the superiority of international treaties approved or ratified by the French Government to domestic laws. However, concerning international customary law, the concrete position about its hierarchy in French domestic legal order is not clear and flexuous in judgements of these three main organs.
