국문 초록

1999년 시애틀에서 개최된 WTO 각료회담이 실패로 끝난데 이은 2003년 칸쿤에서의 실패는 WTO를 중심으로 한 다자무역체제에 심각한 위기가 발생했음을 극명하게 보여 준다. 시애틀과 칸쿤에서 발생한 사태는 WTO의 비민주성으로 인한 병폐를 여실히 드러내는 한편, 그 병폐를 민주주의로 치료하고자 하는 점증하는 요구의 반영이기도 하다. 이러한 요구의 중심에는 현재 진행중인 국제무역의 자유화를 통한 얄은 경제적 통합에서 깊은 통합으로의 변환과정과, 그 과정중에 필연적으로 생기는 통상에 영향을 미치는 각종 국내 규범들과 국제통상규범과의 조우가 있다. 그러나 WTO에 대한 비판은 단순히 WTO가 깊은 경제적 통합을 추진하는 주요 국제기구라는 사실에서 나오는 것이 아니다. 비판은 WTO가 세계적 경제통합을 주도하는 바로 그 방식에서 연유한다고 할 수 있다. WTO를 뒷받침하는 핵심사상인 경제적 자유주의를 필두로, 법률주의로의 제도적 전환과 과학주의의 무역체제로의 도입은 WTO에 의해 강제된 경제적, 법적, 그리고 과학적 합리성이 어떠한 방식으로 일반대중의 통제를 벗어나 시공을 초월한 보편적 미덕으로 포장되어 다양한 가치와 이해들 간의 진정하고 자유로운 경합을 사전에 차단하는 기능을 하는지를 잘 예증한다, WTO를 직ㆍ간접적으로 이끌어가는 엘리트 집단이 자신들의 합리성이 경제적이든, 법적이든, 또는 과학적이든 상관없이 그 합리성 자체에 오류가 내재해 있을 수 있다는 점을 인정하지 않는다면, 합리성에 기초한 정당성은 침식되는 반면에 민주주의 원리에 기반한 정당성에의 점증하는 요구를 초래할 것이다.

영문 초록

In a span of less than four years, two of the WTO Ministerial Meetings have collapsed in a dramatic way. After the violent breakdown of the talks in Seattle in 1999, another failure at Cancun in 2003 cleary signals that the multilateral trading system centred around the WTO has reached a crisis point. Indeed, those fiascos are the symptom that acutely exposes the malady of antidemocratic nature of the WTO while reflecting a growing demand for a cure with a dose of democracy. At the heart of such demands lies the current process of transition from shallow integration to deep integration through international trade liberalization, which inevitably touches also upon trade-related regulatory issues. In this regard, the criticisms against the WTO do not merely result from the fact that the WTO is one of the central institutions driving the deep integration. What really triggers criticisms is the way the WTO dominates the process of global economic integration. Starting with the core creed of economic liberalism, the institutional tum to legalism and the introduction of scientism into the trading system well illustrate how the economic, legal, and scientific rationalities imposed by the WTO system foreclose the possibility that genuine contestation amongst competing discourses may take place by acting as timeless virtue with universal applicability beyond the control of ordinary people who are therefore told to submit to such rationalities. Unless the notion that its rationality, be it economic, legal, or scientific, could be flawed occurs to minds of the WTO elite group, such as economists, trade lawyers, government officials, international bureaucrats, the net result would be the erosion of legitimacy based on rationality and correspondingly mounting demands for legitimacy based on democracy.
