국문 초록

인간배아 줄기세포 수립을 계기로 그 연구와 연구성과물의 이용에 대한 기회와 위험에 대한 논의가 윤리적 관점에서 진행되고 있는 반면, 그 연구성과물의 특허성 인정여부도 관심이 집중되고 있다. 2006년 12월 5일 독일연방특허법원은 배아줄기세포(ES 세포: Embryonic Stem Cell)를 이용한 神經前驅細胞(Neurale Vorläuferzellen)에 관한 특허에 대하여, 인간에서 유래한 배아줄기세포에 관한 부분에 대하여 일부무효의 판결을 내림에 따라 세간의 많은 주목을 받고 있다. 본 논문은 인간배아줄기세포 관련 발명의 특허보호 가능성 및 윤리적 문제를 독일 연방법원특허법원 판례 및 관련 판례와 밀접한 관련이 있는 유럽의 입법동향을 살펴보고 우리나라에 있어서 특허법과 생명윤리와의 관계를 살펴보고자 한다.

영문 초록

Human embryonic stem cells have so far been both isolated and cultured in many countries. The issue raised by the 1998 EU Directive is whether patents on human embryonic stem cells should be granted or not, and the question is still in discussion. The facts are that such patents have already been granted in the US. In a recent decision(December 5, 2006), the German Federal Patent Court(GFPC) pronounced a much-anticipated judgment in a highly contentious nullity action filed by Greenpeace against German Patent DE 197 56 864(herein the ‘864 patent). The subject-matter of this patent relates to the controversial scientific area of human embryonic stem cells, specifically the beneficial use of such cells in neurodegenerative therapies, and was developed by Prof. Oliver Brustle of the University of Bonn(Germany). This paper makes some comments on the German Federal Patent Court decision of December 5, 2006 and raised specific ethical questions related to fundamental ethical principles about the patenting of inventions involving human stem cells.
