정신장애 범죄자를 위한 재활 중재접근법의 이론적 고찰

국문 초록

현대사회는 여러 다양한 문제로 사회적 적응이 어려워지고, 그에 따라 여러 가지 정신질환이 증가하고 있으며, 정신장애자의 범죄도 늘어나고 있다. 이에 우리나라는 치료감호제도를 시행하여 정신장애 범죄자를 치료 및 보호하고 그들의 사회복귀와 자립을 돕고 있다. 이러한 제도시행과 더불어 정신장애 범죄자에 대한 재활 분야는 점차 확대 되어 가고 있긴 하나 정신장애 범죄자들의 치료중재에 대한 이론적 근거가 미흡한 실정이다. 따라서 본 연구에서는 정신장애 범죄자들의 재활 중재접근법에 관한 문헌들을 검토해보고 그 중 가장 적합한 이론모 델을 제안해 보고자 하였다. 치료감호에 대한 현 시점의 치료적 접근법들은 정신병리학적 패러다 임을 기반으로 한 중재접근, RNR 모델과 이를 근거로 한 R&R2M 프로그램과 사고기술 강화프로그램, 장점 기반 접근법인 GLM-F, Tidal model 등이 있다. 이 중 정신장애 범죄자들을 대상으로 가장 널리 적용되고 있는 중재법은 정신병리학적 패러다임과 RNR 모델이나 이론적 접근법이 있음에도 불구하고 정신장애 범죄자에 대한 치료 및 재활 접근법 효과성에 관련된 국내 문헌은 거의 전무하였다. 또한, 이 두 중재 접근법은 서로 다른 관점으로 임상현장에서 상충되고 있으며, 통합적 용하기 어렵다. 이를 보완하기 위한 접근법으로 최근 강조되고 있는 장점 기반 접근법 중 Good Lives Model(GLM)이 있다. 이 모델은 기존의 중재접근법과 달리 범죄를 넘어서 “좋은 삶”을 성취하고 개인의 목표와 장점을 고려함으로써 재범에 대한 위험을 관리하고 동시에 범죄자의 개인적 목표를 성취하고자 한다. 아직 부족하긴 하나 국내 연구들 중 GLM을 기반으로 한 프로그램 개발 및 효과성 검증을 통해 GLM은 범죄에서 벗어나 건강한 삶으로 전환할 수 있는 좋은 삶의 순환고리를 만들 수 있는 중재접근법임을 확인하였다. 따라서 앞으로 정신장애 범죄자를 대상으로 한 중재접근법으로 GLM이 가장 적합한 것으로 사료되며, GLM을 기반으로 한 프로그램 개발과 그 효과성 검증 연구가 확대될 필요가 있다.

영문 초록

In modern society, because of various complex problems it is difficult to adapt socially. So, many people have mental illness, simultaneously there is an increasing tendency to commit a crime. The crimes of people with mental illness have been repeated, the media has emphasized awareness and countermeasure of these problems. Currently, the nation have forensic mental health system as security measure instead of punishment for mentally disordered offenders. The purpose of cure-custody system is to return to their community and treat psychiatric symptoms of MDOs and to protect community from violence of MDOs. Until recently, fields of forensic rehabilitation with MDOs has been expanded but there is a paucity of literature on theoretical basis for MDOs Therefore, We reviewed literatures on intervention approaches with MDOs. We identitified that there are three broad approaches to forensic rehabilitation; treatments targeting mental illness and other psychological issues, R&R2M program and enhanced thinking skills program based on the principles of the Risk-Need-Responsivity(RNR) model and GLM-FM, Tidal model based on strength-based intervention. But despite of various theoretical approaches, there are little literatures on efficacy of intervention with MDOs. Also, there is lack of theoretical background on psychophathological paradigm and RNR model Recently, there is emphasis on GLM model of strength-based approach but little research applying GLM model for MDOs except sex offenders and adolescent under probation. Therefore, Further study will have to establish theoretical model for MDOs and need to investigate efficacy of programs based on each intervention approach.
