국문 초록

우리나라는 지속적인 경기침체와 실업률 증가, 고령화의 가속화, 다문화 사회에 따른 갈등, 범죄의 다양화 등으로 인한 많은 사회문제들이 나타나면서 그에 따른 치안수요가 급증하고 있다. 그러나 이에 대처하는 공권력은 한정되어 치안서비스의 균형적인 공급이 쉽지 않아 민간경비제도를 통하여 일정 부분 공백을 보완하고 있으나 범죄수사나 소송활동에 있어서 국민이 이용할 수 있는 서비스는 그 제약이 많은 것이 사실이다. OECD가입국 중에 유일하게 민간조사제도가 법제화 되어 있지 않아 국내의 민간조사시장을 외국계 민간조사업체에서 독차지하고 있어 민간조사제도의 도입은 시대적 변화에 따라 점점 그 필요성이 더해가고 있는 실정으로 더 이상 미룰 수 없는 제도임에도 국민의 사생활 및 인권 침해, 변호사 직업군과의 충돌, 수사기관과 업무의 영역 침해 등 여러 반대의견이 많아 제도화하는데 어려움을 겪고 있다. 따라서 본 연구에서는 민간도사제도의 도입에 대한 기대효과와 반대 의견을 취합하여 민간조사제도 도입에 대한 의견을 제시하고자 한다.

영문 초록

The demand for public order is increasing in our country due to numerous social issues including constant economic recession, increasing unemployment rate, acceleration of aging society, conflicts among multi-cultural society, and diversification of criminals. Yet, as there is a limited governmental authority to deal with it, equal supply of public order service is not easy. Hence, lack of supply is somewhat supplemented through private security system, however, there are still restrictions for citizens in using services including criminal investigation and litigation activity. As the only country among OECD to not have private detective system legislated, foreign private detective firm is exclusively possessing domestic private detective market, and the necessity for the introduction of private detective system is increasing over time. Nevertheless, due to various opposing opinions including privacy and human rights violation, conflict with occupational cluster of lawyers, violating the territory of investigation agency and their business, they are having difficulty in institutionalizing the policy. Hence, by gathering the expectations and opposing opinions about implementing private detective system, this research will suggest opinions for the introduction of private detective system.
