국문 초록

급격한 사회변화에 따라 오늘날의 범죄를 비롯한 사회적 갈등은 예전보다 훨씬 다양한 형태로 우리 사회를 위협하고 있다. 이러한 위협에 대응하기 위해 개인들은 스스로 재산과 권익, 안전을 보호하고자 하는 경향을 보이며 이는 다양한 치안서비스에 대한 수요의 증대로 나타다고 있다. 이는 공인탐정 제도를 양성화하여 민간 자체적으로 해결 가능한 분야는 최대한 자율성을 보장 해주고 이에 대한 부작용을 법률과 규제로서 최소화하는 것이 바람직하다는 주장이 계속 제기되고 있는 이유이기도 하다. 그러나 과거 흥신소업과 심부름센터에서 이어져온 부정적인 인식 그리고 최근 증가하고 있는 정보유출 사례와 사생활 침해의 우려를 이유로 공인탐정 제도의 입법화가 매번 지연되어져 오고 있다. 외국의 주요 선진국 사례에서 보듯이 공인탐정은 고객으로부터 계약에 의한 보수를 받고 경찰과 협력하여 의뢰한 업무를 조사하고 정보를 수집하여 주는 업무를 말하며 국민의 생명과 재산 그리고 치안환경에 이바지하고 있는 민간경비의 주요산업으로 성장하고 있다. 우리의 현실에서도 탐정은 고도로 지능화되고 흉악 해지는 범죄의 증가에 따라 경찰의 한계 영역을 대신하여 국민들이 생명과 재산을 보호하는 역할을 할 것임이 분명하다. 다만 입법을 위한 방법론에 있어서 우선 국민 대다수에게 홍보과 관심유도를 통해 필요성에 대한 광범위한 동의를 유도해내고 각 이해관계 기관의 쟁점문제를 협의를 통해 원만하게 조율하고 파급효과가 미치는 다양한 이해관계 분야의 의견과 추후 발생할지 모르는 문제점들에 대하여 검토하고 대응하는 현명한 자세와 노력이 어느 때보다 요구 된다고 할 것이다.

영문 초록

As the sudden social changes, the current crime or social conflict threatens our society in various styles than we have ever been. To counteract these threats, individuals have a tendency to protect themselves for their property, right and interest and security. This demonstrates the increase in demand for the diverse security services. Therefore, it has been claimed that the official detective systems are to be legalized to guarantee more autonomy to the soluble area by themselves and to minimize the side-effects by means of the act and regulation. Unfortunately, the introduction of the official detective systems have been delayed, for that the negative perception from a bypast detective agency and concern about the increasing information spill and invasion of privacy. In some advanced countries, for instance, the official detectives are paid under the contract by playing a role to collaborate with the police, investigate the requests from the client and collect the information. This key industry of private security is currently growing that leads to maintain the life, property and public order of the people. In reality, the intelligent and heinous crimes are highly increasing. In accordance to this, it is obvious for detectives do their duties for the life and property of the people instead of the limits of the police.formation of opinions in the related fields that resulted from the introduction of the system and the effort to examine the further possible problems are required.
