스마트TV의 규제 근거와 법적 지위에 대한 연구

국문 초록

기술융합에 따라 신매체가 구매체와 유사한 서비스를 제공함에도 불구하고 둘 간의 규제격차가 심할 경우에는 규제갈등과 규제공백을 가져올 가능성이 크다. 이 연구는 두가지 관점에서 스마트TV에 대한 규제 타당성과 규제 수준을 살펴보았다. 첫째, 매체적 특성요인이며, 둘째, 이해관계자 인식 요인이다. 이 두가지 요인은 지금까지 국내에서 신매체의 법적 성격을 규정짓는데 참고해온 핵심 요인들이라고 볼 수 있기 때문이다. 스마트TV의 기술적 특징을 기존문헌과 심층인터뷰를 통해 분석하고 관련법에서의 수용가능성에 대해 분석하였다. 또한 스마트TV에 대한 법적 지위 및 규제 수준 그리고 쟁점 규제 이슈에 대해 관련 전문가들의인식과 입장을 알아보았다. 이를 토대로 스마트TV의 실시간방송에 대해서는 기존유료방송사업자에 준하는 법적 규제를 행할 필요가 있으며, 방송법, IPTV법, 전기통신사업법 상의 행위규제에서 나타나는 비대칭규제 문제를 우선적으로 해결할 필요성이 있다는 결론을 제시하였다.

영문 초록

OTT(over-the-top) as the most fast growing new media services since 2010 is recently giving rise to an asymmetric regulation conflicts in Korean broadcast market. It is because that OTT services are relatively under the uncontrolled or relaxed regulation structure compared to the similar services such as the cable television operators or IPTV providers which must compete with largely unregulated internet-based TV services. This study examines the adequacy and level of controls on OTT services based on the two aspects - technological factor and awareness factor among interested parties. The two key factors have the most powerful explanation ability in predicting and prospecting the future of a new media under the Korean media policy making process. To solve the three research questions we used the depth interview and focus group interview targeted 22 specialists including scholars, broadcasters, OTT providers and officials of regulation agency. This paper concluded that OTT is the similar services with other pay TV services, especially IPTV services, so the government needs to improve the regulatory frameworks to keep up with the rise of online video and to impose the TV-like regulation, especially in the field of real time broadcasting and control of business practices.
