2016년 총선의 헌법적 의의와 정치개혁입법의 방향

국문 초록

2016년 4월 13일 치러진 국회의원 총선거의 결과는 여당의 압도적 승리를 점쳤던 일반의 예상을 완전히 빗나갔다. 국민들은 제왕적 대통령제 하에서 무기력했던 여당에 대해서 뿐만 아니라 양자간 대립으로 비생산적이었던 국회의 양당구도에 대하여도 불신임하였다. 3당이 정립한 가운데 여소야대로 국회가 구성되었다. 어느 정당도 국회에서 프리마돈나역할을 구가할 수 없게 되었다, 제20대 국회는 이제 더 이상 다수 민주주의 내지 다수의 전제(專制)가 아니라 협치, 파트너십 민주주의, 합의민주주의를 실험하라는 국민의 명령 앞에 서게 되었다. 또한 국회는 대의기관으로서 국민의 실제 의사를 꾸준히 경청하고 반응할 책임을 지고 있다. 이와 같이 ‘분권’과 ‘협치’를 지향하는 시대정신에 부응하기 위하여, 제20대 국회가 우선적으로 다루어야할 과제를 꼽아보았다: 첫째 헌법개정의 경우, 국민을 개헌의 전과정에 포용하는 절차를 만들어 헌법개정의 정당성을 확보하는 것이 우선하여야 하고, 그 다음에 내용 논의를 하여야 한다. 둘째, 정치관계법의 경우, 언론․출판, 집회, 결사의 자유 등 정치적 표현의 자유를 최대한 보장하는 방향, 정당의 설립 및 가입의 자유를 대폭 확대하는 방향, 저비용 고효율의 정치를 정착시키는 방향, 선거운동의 자유를 보장하는 방향, 국회운영의 규칙을 구체화하는 방향, 불법․부당한 명령에 대한 공무원들의 이의제기권을 보장하는 방향의 관계법률 개정이 요청된다. 마지막으로 시민교육 없 이는 민주시민이 있을 수 없고, 민주시민 없이는 민주주의가 있을 수 없다. 따라서 민주시민교육을 실시할 기관을 중앙과 지방에 건립하고 정부에서 예산을 지원하는 입법을 마련하는 것이 시급하다. 4.13 총선으로 마련된 천우신조의 기회를 잘 활용함으로써 한국의 민주주의가 공고화되기를 바란다.

영문 초록

The result of General Election held in April 2016 in Korea was unexpected. The People of Korea showed not only a serious distrust of the ruling party under the so-called ‘imperial presidency’, but also criticised non-productivity of the National Assembly caused by continuous conflict between two big parties. Now, the cooperation of three Parties in the Parliament is inevitable in order to pass the act and the other important resolutions. The 20th National Assembly must be operated not on the basis of majoritarian democracy, or the tyranny of majority any more, but try an experiment on partnership democracy or consensus democracy. The Parliament should be responsive to the real will of the people. According to the spirit of the times(“Zeitgeist”), the Parliament must deal with following tasks. First, by the Act of Constitutional Amendment Procedure, the right of the people to participate in the whole process of constitutional amendment must be guaranteed. Second, a number of laws relating to the politics must be amended (ⅰ) to maximize the freedom of political expression, the right to assemble & demonstrate, and to form associations; (ⅱ) to expand the freedom of establishment of political parties and the right to join a party; (ⅲ) to establish a low-cost and high efficiency model of politics; (ⅳ) to regulate the internal operation of the National Assembly in detail; (ⅴ) to guarantee the civil servant to raise objection against illegal or unreasonable order from his superior. Finally, it is needed urgently to establish the institutes for civic education not only at the national level but also at the local. Because there’s no democratic citizen without civic education as well as no democracy without democratic citizens. It is the historic challenge facing our new parliament to consolidate democracy, which is recently in recession in Korea.
