국문 초록

최근 학교폭력은 국가적 차원의 노력으로 줄어들고 있다는 언론의 보도가 있다. 하지만, 현실에서는 여전히 학교폭력이 계속해서 존재하고 있고 학생들은 학교폭력의 위험속에서 생활하고 있다. 학생은 학교에서 안전하고 행복하게 교육을 받을 권리가 있다. 학교폭력이라는 위험에서 학생의 안전을 확보하기 위해 법·정책적 노력을 하였음에도 불구하고 학교폭력이 줄어들지 않는 것은 법과 정책에 있어서 문제점이 있기 때문이다. 나아가 법률의 시행과정과 정책에 의한 프로그램의 운영과정에서 문제점으로 인해 실효성을 거두지 못하기 때문이다. 또한 학교폭력예방법에 있어서의 인권침해요소와 법률에 기인하여 시행되는 각종 프로그램에서도 인권침해요소가 발생되고 있다. 본 논문은 학교폭력대응과정에서 발생되는 인권침해가 되는 법률조항과 예방을 위해 실시되는 프로그램 운영과정에서 발생되는 인권침해요소를 지적하고자 하였다. 즉, 학교폭력예방을 위한 프로그램의 하나인 학생자치법정과 학교폭력예방법 제13조의 학교폭력대책자치위원회의 구성에 있어 발생될 수 있는 프라이버시권 침해에 관한 문제와 학교폭력예방법 제17조의 가해학생의 대한 조치 중 ‘서면사과’의 처분에 대한 학생의 양심의 자유를 제한한 것에 대한 문제를 제기하고, 그 해결방안을 제시하였다.

영문 초록

Recently, there was a report from the media that bullying at school has been reduced due to measures at the national level. However, bullying at school still exists in reality and students are in danger of school violence. The students have the right to be educated in a safe and pleasant environment. Regardless of the legal and political measures taken to secure safety of those in school from bullying, the number of violations does not decrease, which implies the problem is with the law and policy. Furthermore, it s not effective because of problems in the operation of the program through the process of the enforcement of the law and policy. Also, the human rights violation occurs in school bullying prevention programs based on law and human rights violation factors. This study is to point out the human rights violation factors from school bullying prevention program processes and laws. In other words, it is to bring up the privacy violation problems that could be occurring in students court and school bullying prevention committees according to the school bullying prevention law article No. 13. one of the school bullying prevention programs, and problems with the school bullying prevention law article No. 17 that limits student s self awareness through the use of a written apology as a form of disciplinary measure for student s wrongdoing, as well as to suggest possible solutions.
