국문 초록

최근 개발된 부위 특이적인 CRISPR-Cas9 핵산분해효소는 현행 유전자 변형 방법에 비해 비교적 손쉽게 사용할 수 있고 정밀 편집이 가능하기 때문에, 기존의 윤리적 물음들을 좀 더 현실적으로 만들거나 새로운 윤리적 물음을 제기하고 있다. 이 논문에서는 이 기술이 제기하는 윤리적 물음들을 유전자 치료, 유전자변형생물체의 제조, 유전자 드라이브라는 측면에서 검토해 보았다. 기초생물학 연구와 체세포 유전자 치료가 제기하는 윤리적 문제가 상대적으로 적으나, 생식세포의 치료는 의도적 편집을 통한 아이 출산의 정당성, 배아 등 생식세포 사용의 정당화문제, 다른 대체 방법의 사용 문제, 실제 적용사례의 제한, 미래세대의 동의를 받지 못하는 문제, 예상하지 못하는 위험성 발생, 후손의 정체성과 미래에 영향을 미치는 문제, 인간 유전자 풀에 미치는 영향, 사회적 격차 발생, 유전적 증강 등의 문제가 있다. 유전자변형생물체의 제조와 관련해서는 기존의 유전자변형생물체가 제기하는 기아 추방의 해결책이라는 주장의 정당성, 유전자변형생물체에 의한 환경오염, 윤리적으로 문제가 되는 유전자 포함, 생명공학회사의 농업 예속과 빈국 소농의 몰락, 유전자 사유화 및 농민의 육종 권리 무시, 자연 침해, 신에 대한 도전 등 이외에도 새로운 유전체 편집 방법에 의한 규제 회피의 위험성을 제기한다. 유전자 드라이브와 관련하여 ‘신성한 개념' 개념에 비추어, 종 멸절의 윤리적 정당성, 위험성이 덜한 다른 방법으로 대체 가능성, 비표적 종 및 근연종에 작용할 가능성, 기존 개체군 내로 확산가능성, 군집 동태에 비의도적 연쇄반응 초래 가능성, 생태계에 미치는 악영향, 유전자변형생물체의 확산을 규제하는 법령 재정비 필요성, 생물무기 등에 악용 가능성 등의 문제가 제기된다. 이처럼 CRISPR-Cas9 기술은 의무론적, 결과주의적 문제와 아울러 사회적, 법적 문제를 제기하므로, 이 기술의 바람직한 발전을 위해서는 그 적용 범위와 규제를 결정하기 위한 과학자와 일반대중을 포함하는 이해당사자간의 숙의가 필요하다.

영문 초록

CRISPR-Cas9, recently developed site-specific nuclease, is relative ease and high precision compared to the conventional gene modifying tools. Therefore it makes old ethical questions real and raises new ethical questions. The focus of this paper will be on the several ethical questions raised in the areas of gene therapy, genetic modification of organisms, and gene drive. Germline editing raises different questions from basic research and somatic editing, such as the deliberate editing for reproduction, the use of human embryo, the relative efficacy to the alternate methods, fear of the unknown results, the identity and open future of future generations, human gene pool, genetic disparity, and genetic enhancement. Genetic editing of organism raises old questions on the legitimacy of the argument for reducing hunger, environmental contamination by genetically modified organisms, inclusion of ethically sensitive genes, distribution of risks and benefits, profit monopolization and gene privatization by biotech companies, exclusion of farmer's breeding right, neglects of naturalness and God's wish, alike the conventional genetic engineering, and new questions including the escape from the GMO regulation. Gene drive raises questions on the species extinction against 'sanctity of life', use of less dangerous options, gene flow to the unintended and related species, spread of gene drive to the susceptible native populations, unintended cascades for community dynamics, deleterious effects on the overall ecosystem, regulation to prevent transnational diffusion, and the development of the biological weapons. In summary, many deontological and consequentialistic questions, as well as the societal and legal questions raised by CRISPR-Cas9 could be solved by deliberation between stakeholders including the expert and the public on the application and regulation of this technology.
