국문 초록

입법권은 삼권분립원리에 의해 국회에게 주어진 가장 본질적인 권한이다. 이런 이유로 국회 입법 권한의 내실화야말로 국회 권한 내실화의 가장 기본적이고 본질적인 목표가 된다. 2012년 5월 2일에 입법 갈등의 완화뿐만 아니라 입법 효율성을 증진하고자 하는 염원을 담고 국회법 개정안인 ‘국회선진화법안’이 국회 본회의를 통과했다. 따라서 국회 입법 권한의 내실화 방안 마련의 전제가 되는 국회 입법 권한의 현황 파악을 위해서 국회선진화법 도입 후의 현황을 파악하고 여전히 문제점이 발견된다면 그에 대한 제도 개선 과제를 살펴보는 작업이 필요할 것이다. 본 연구는 우리 헌법상의 기본원리인 대의제원리와 삼권분립원리 하에서 이러한 국회 입법 권한 행사의 현황을 진단해보고 입법 권한 내실화의 관점에서 여러 문제점들을 도출하며 문제 해결을 위한 제도 개선의 과제를 모색해보는 것을 연구의 목적으로 삼는다. 이를 위해 우선 입법 권한 내실화의 헌법상 기준이 되어야 할 대의제원리와 삼권분립원리에 대해 개관해보고, 단계를 나누어 국회 입법발의 단계에서의 현황과 제도개선 과제, 국회 위원회와 본회의 심의 단계에서의 현황과 제도개선 과제를 살펴본 후, 입법보좌기능의 강화와 행정입법 통제 강화를 통한 국회 입법권한의 내실화 방안에 대해 생각해본다.

영문 초록

The legislative power is the most essential power given to the National Assembly of the Republic of Korea by the Separation of Powers principle in Korean Constitution. For this reason, the substantiality of the legislative power would become the most fundamental and essential aim for the substantiality of the power of National Assembly. On the 2nd day of May in the year of 2012, the National Assembly enacted the so-called ‘National Assembly Advancement Act’ longing not only for the conflict mitigation among the political parties but also for the enhancement of legislative effectiveness. Hence, to precisely understand the current situations of National Assembly, we should examine the problems after enacting the National Assembly Advancement Act and explore the institutional improvement issues for the substantiality of legislative powers of National Assembly in Korea. This paper aims at examining the present situations in legislative powers by the National Assembly in the perspective of the Representative System and the Separation of Powers principle in Korean Constitution, deducing the problems and, finally, exploring the institutional reform measures to solve the problems. To achieve the aim, this paper will overview the Representative System and the Separation of Powers principle in Korean Constitution at first. Then, it will examine the current situations in legislative powers by the National Assembly and explore the institutional reform measures in each and every stages of the legislation processes in the National Assembly of the Republic of Korea as well as in the administrative rule-making processes by the administration.
