국문 초록

1987년헌법은 우리나라 헌정사에서 민주항쟁의 결과로 여야 합의로 개정되고 국민투표를 거쳐 확정되었으며 현재까지 운영되고 있는 최장수 헌법이다. 현행 헌법은 1987년 민주화 과정을 통해 탄생하였는데 특히 1986년 각 정당 헌법개정안이 나온 이후 당시 대통령의 호헌 발언, 6월 민주화항쟁과 6ㆍ29선언, 대통령직선제 합의 등 정치적 격동의 과정에서 국민적 헌법개정의사가 적극적으로 표출되는 과정을 통해 탄생하게 된 것이다. 1987년헌법 개정안이 구체화되는 절차는 8인 정치회담과 국회 헌법개정특별위원회에서였다. 8인 정치회담에서 대통령 직선제 등 주요한 쟁점사항은 사실상 국민적 요구를 수용하기로 하였기 때문에 약 1개월이라는 비교적 길지 않은 시간에 헌법개정안 협상을 진행하였다. 정치적인 쟁점의 타협과 합의는 8인 정치회담에서 이루어졌지만 헌법개정안 조문화는 국회 헌법개정특별위원회를 통해 이루어졌다. 정부형태에 있어서는 민주정의당안에서는 대통령 직선, 임기 6년의 중임 금지, 부통령이 없었던 반면 통일민주당안과 신한민주당안은 대통령과 부통령의 직선 단일투표제, 4년 1차 중임, 부통령 신설, 국무총리 존치라는 특징을 띠고 있었다. 사법부에 있어서 통일민주당안과 신한민주당안은 법관추천회의를 신설하였고, 민주정의당안에는 헌법재판소를 신설한 것이 특징이었다. 1987년헌법 개정이 우리나라 헌법개정사에 있어 민주항쟁과 여야합의에 기초한 민주적 헌법개정이라는 평가가 많지만, 개헌안 형성과정에서 일반국민과 충분한 의사소통절차를 거치지 않았다고 보는 비판적 견해도 있다. 그러나 이에 대해 당시 헌법개정에 참여했던 국회의원들은 대체로 6월민주항쟁으로 국민들의 의사가 충분히 표출되었고 정치권은 이를 충실히 반영했다는 입장이다. 1987년헌법개정안 형성과정을 살펴보았을 때, 헌법개정안 마련을 위한 국회의 특별위원회 또는 자문위원회 등의 구성은 헌법개정의 담당자를 정하거나 헌법개정의 방향성을 정하는 것과 밀접한 관련이 있기 때문에 정당성을 최대한 높인 방식을 채택하여야 한다.

영문 초록

The present Korean Constitution was established through the democratizing process in 1987 and was revised and reformed according to people’s active expression of intention for the amendment of the Constitution. It was made by an elite-driven proposal of constitutional reform such as the talk of eight. The bill for the constitutional amendment in 1987 was finalized at the talk of eight and the special commission for the Constitutional Amendment in the National Assembly. Because the people’s voice on major issues including a direct presidential election system was heard at the talk of eight (8), the revised bill of the Constitution was negotiated for a relatively short period of time, about one month. At that time, there was some resistance to the amendment of the Constitution by the people, but it seemed hard to deny that the actual establishment of the amendment of the Constitution was made by the decision of some politicians and an elite negotiation. In terms of the form of government, there was negotiation between the direct election system of a single six-year term suggested by the Democratic Justice Party, and the president and vice president system of two four-year terms suggested by the opposite party. Also, the formation of the Constitutional Court proposed by the Democratic Party was adopted, but a judicial nominating commission proposed by the opposite party was not adopted. In the process of negotiation, a system of constitutional appeal was added. The amendment of the Constitution in 1987 is the most democratic revision of the Constitution in the history of Korean constitutional reform, but there is an another view that the bill for Constitutional Reform did not include adequate communication with people, which was a problem in the process of forming the bill for the Constitutional Reform. However, members of the National Assembly who were involved in the amendment of the Constitution have said that people’s opinions were adequately expressed through the June Democracy Movement in 1987 and the political circles adequately reflected such people’s opinions. The formation of a special commission for the bill for Constitutional Reform at the National Assembly may affect the Constitutional Reform process. Therefore, it should adopt the system which maximizes its legitimacy.
