한국교육의 사회민주주의적 요소

국문 초록

이 글에서는 한국교육의 사회민주주의적 요소를 살펴본다는 차원에서, 정치이념으로서의 사회민주주의가 지향하는 교육전략인 ‘사회민주주의적 교육관’에 주목하여 그것이 공동체 운영의 기본철학이 담겨있는 ‘헌법’과 헌법의 권위적 해석물인 ‘헌법재판소판례’에서 어떻게 나타나고 있는지를 분석하였다. 이 글의 본문은 다음과 같이 구성되어 있다. 우선 사회민주주의 정치이 념의 교육적 지향과 헌법적 반영을 살펴보는 Ⅱ장에서는, 교육에 대한 국가의 개입을 인정하는 사회민주주의의 공교육관과 보편복지에 수렴하는 교육민주주의전략 등을 언급하고, 헌법상의 교육기본권 조항의 분석에서는 우리헌법 속에 사회민주주의적 교육관이 내재한다는 것을 최대한 옹호하였다. 다음으로 교육헌법판례를 분석하는 Ⅲ장에서는 사회민주주의적 교육관의 틀에서 28건의 교육헌법판례를 비판적으로 분석하였는데, 판례분석결과 헌법재판소는 원리‧원칙‧선언과 같은 추상적 수준에서 사회민주주의적 교육관에 수렴하는 진보적 헌법해석을 시도하지만, 그것이 구체적인 입법‧정책과 연계되는 사항에서는 진보적 헌법해석을 희석시켜 보수주의로 회귀하는 경향이 나타남을 알 수 있었다. 또한 사회민주주의적 교육관에 근접하는 진보적헌법해석을 시도하고 있는 것들은 추출판례의 다수의견 보다는 ‘소수‧반대의견’ 속에서 많이 발견되었다는 점도 언급하였다.

영문 초록

The purpose of this article is to examine how appearing Social democratic educational view through the Constitution that contained basic philosophy of community operation, and Constitutional court case law that authoritative interpretation of constitution. this article is largely made up two parts. First, at the section dealing with the Social democratic educational view and an analysis on the educational constitutional provisions, referred public educational view to admit the state involvement in education field and educational democracy strategy that close to universal welfare system. and an analysis on the educational constitutional provisions, advocated the Social democratic educational view is existed in Korean Constitution. Second, at the section dealing with an analysis on the constitutional court educational case law, analysed 28 case law in the framework of social democratic educational view. a consequence of the constitutional court case law analysis, could see the progressive constitutional interpretation with the principles, fundamentals, and abstract level, which convergence in the social democratic educational view. However, progressive constitutional interpretation was tend to revert back to Conservatism, in specific matters relate to legislation, policy etc. Also, referred the progressive constitutional interpretation that close to social democratic educational view were found in a lot of rather minority opinions than majority opinions on sampling case law.
