교육영역에서 복지국가원리의 구현

국문 초록

교육영역에 대한 헌법이론적 연구가 심화되어 현행 헌법 제31조의 해석론을 기초한 교육기본권의 내용과 효력, 교육의 자주성, 전문성, 정치적 중립성의 의미가 매우 구체화되었고, 교육영역에서 법률관계의 당사자와 그들이 가진 권리, 의무, 권한을 확정되고 그에 따라 이들의 협력, 갈등이 발생하였을 때 이를 어떻게 해결하여야 하는지 문제 해결 능력도 매우 높아졌다. 그러나 헌법의 기본원리와 교육이 어떤 관계를 맺고 있는지에 관한 연구는 상대적으로 소홀하였으며, 특히 복지국가원리와 교육이 어떠한 관계이어야 하는지는 진지하게 논의된 바 없다. 이 글은 교육영역에서 헌법상 기본원리 중 하나인 복지국가원리가 어떠한 함의를 담고 있는지 이론적으로 해명하고, 그러한 함의가 구체적인 교육정책에 어떠한 영향을 끼쳐야 하는지 실천적인 관점에서 검토하고자 하였다. 이를 위해서 우선 교육과 복지국가원리가 서로 어떠한 관계가 있는지, 어떠한 관계가 되어야 하는지 이론적인 관점에서 검토하였다(Ⅱ). 그리고 그 실천적 담론인 교육복지론의 개념과 그에 근거한 정책, 법제화 동향을 정리하고 평가하였다(Ⅲ). 마지막으로 이상의 논의를 정리하며 글을 맺었다(Ⅳ). 전통적으로 국가의 교육에 대한 개입은 국가가 다양한 재분배 기능을 통하여 시민의 실질적 자유와 평등을 보장하고 인간다운 생활을 할 권리를 보장해야 한다는 복지국가원리에 따른 기능으로 이해하지 않았다. 그러나 자본주의가 발달함에 따라 양극화로 요약되는 사회적 불평등이 교육 불평등으로, 세대간 지위의 대물림으로 순차적으로 전화되면서 그에 대한 대응으로 교육의 불평등을 해소하기 위하여 국가가 행위를 하여야 한다는 요구가 커졌다. 교육이 위와 같은 악순환의 연결 고리를 끊고 '희망의 사다리'를 놓는 수단으로 기능하여야 한다는 것이다. 이러한 단계에 이르면 분배 전(前)과 분배 단계에서 중요한 기능을 하는 교육이 복지국가원리에 따른 국가 정책에 중요한 영역으로 등장한다. 우리나라는 이러한 흐름이 교육복지론으로 논의되었다. 이러한 담론은 복지국가의 관점에서는 재분배보다는 분배에 관심을 갖도록 시야를 넓혀주는 기능을 수행하기도 한다. 그러나 교육복지론이 극복해야 할 과제도 있다. 첫째, 교육복지론에 근거한 교육복지정책이 헌법 제31조 제1항 교육기본권의 해석론으로 국가에게 요구할 수 있는 것이 아닌가 의문이다. 둘째, 교육복지론 그 자체는 긍정적으로 평가하더라도 교육에서 이것만을 지나치게 강조할 경우 발생할 이론적 문제를 고려하여 논의를 발전시켜야 한다. 우선 교육은 교육복지론에서 강조하는 기능만 수행하는 것이 아니다. 그리고 교육영역은 복지국가원리의 관점보다는 민주주의원리, 문화국가원리가 영향을 많이 미치는 영역이다. 따라서 교육정책을 구현하는데 복지국가원리의 관점만을 투영하여서는 아니된다. 셋째, 교육복지론 그 자체를 긍정적으로 평가하고 위에서 제기한 이론적 문제점을 고려하여 논의를 발전시키더라도 이에 근거한 교육정책을 설계하고 집행하는 단계에서 대두될 수 있는 문제를 고려하여야 한다.

영문 초록

As researches on constitutional theories in the educational field go further, the meaning of the fundamental rights, the independency, and political neutrality of education has been more specified, and the ability to resolve the conflicts of interest has been developed. However, the researches on the relationship between basic principles of the Constitution and education have been relatively neglected. In particular, how the relationship between basic principles of the Constitution and education should be is not discussed in earnest. This study analyzes the implications of the principle of welfare state in the education field, and considers what effects of the implications should be done on the specific education policies. For this purpose, the relationship between the principle of welfare state and education is reviewed (II). The concept of education welfare and the policies based on it, and the legislative trends are evaluated (III). Finally, it concludes summarizing the discussion (IV). Traditionally, the intervention of the nation to the education has not been regarded as a function based on the principle of welfare state that a nation should guarantee the right of human life by allocation. However, the needs for a nation to resolve social inequality caused by educational inequality have been increased. The vicious cycle should be cut by education opportunities. Education seems to be important at the stage of allocation or before the allocation. In Korea, it is discussed in the education welfare theories. There are obstacles for the education welfare theories to overcome. First, it is about whether the education welfare policies based on the theories can be requested to a nation by the interpretation of Article 31 para 1 of education right. Second, a certain education policy should not be based on only the principle of welfare state because education field is easily affected by the principle of democracy or the principle of cultural state rather than the principle of welfare state. Third, the education welfare theories are suggested as the criteria for activities of the executive branch or parliament not for the judicial branch. The education welfare theories should be institutionalized by policy decision makers and the executives.
