교정 분야 공무원의 직무상 위험요인과 감소방안에 관한 질적 연구

국문 초록

이 연구에서는 질적 연구 방법을 통해 교정 공무원과 보호관찰 공무원 등 교정 분야 공무원들이 경험하고 있는 다양한 직무상 위험요인을 분석하고, 이를통해 향후 교정 분야 공무원들의 직무상 위험요인을 감소시킬 수 있는 정책적방안에 대하여 모색하였다. 연구결과 교정 분야 공무원들은 소수의 신체적 폭력과 더불어 폭력 직전의 위험상황, 언어적 폭력에 수시로 노출되었으며, 직무수행과정에서 발생하는 고의적인 지시불이행과 적법한 공무집행에 대한 항거 역시 자주 경험하는 것으로 나타났다. 또한 주로 교정 공무원들은 청원, 정보공개 청구, 국가인권위원회 진정 등 행정적 위험요인 뿐만 아니라 고소, 고발 등 사법적 위험요인도 다수 경험하였으며, 교정 공무원들과 보호관찰 공무원 모두 과도한 업무량과 부족한 인력으로인해 상당한 수준의 신체적 위험과 정신적 스트레스, 그리고 낮은 직무만족도를경험하고 있는 것으로 나타났다. 뿐만 아니라 수용자나 보호관찰 대상자의 자해, 자살 등과 같은 사고 발생 위험에 대한 우려가 큰 것으로 나타났으며, 이로 인해 교정 분야 공무원들은 자신의 신분 불안을 인식하고 있는 것으로 분석되었다. 그러므로 향후 관계 당국에서는 첫째, 교정 분야 공무원의 신체적, 언어적 폭력과 같은 위험요인을 감소시키기 위해 보다 안전한 직무환경을 조성하고 관련공무원들에 대한 안전장치를 마련해야 한다. 둘째, 행정적‧사법적 위험요인을 감소시키기 위해 교정 공무원에 대한 청원, 진정, 정보공개 청구 등의 사유와 가이드라인을 엄격히 규정하고 교정본부나 범죄예방정책국 소속의 소송 관련 전담직원을 확충하여 보다 조직 차원에서 적극적으로 대응할 수 있는 시스템을 구축해야 한다. 셋째, 직무특성에 따른 신체적, 정신적 위험 요인의 감소를 위해 교정본부에서는 교정 인력을 보강하여 교대제 근무로 인해 야기되는 위험요인을 해소하고, 범죄예방정책국에서는 적정수준의 보호관찰 기관 증설과 더불어 보호관찰 공무원 충원, 탄력적인 근무시간제 도입, 여가선용 기회의 확대, 적정 보상체계 마련, 면밀한 의학적 진단 및 치료 체계 등을 구축해야 한다. 넷째, 기타 위 험요인인 수용자나 피 보호관찰대상자의 자해, 자살 등과 같은 사고 발생 위험과 대응상 고충 해소를 위해서는 사고 예방을 위한 적절한 교육 프로그램을 강화하고, 과학적 데이터 분석을 통해 사전예방 방법 및 사고 발생 시의 신속한대처요령을 숙지할 수 있도록 해야 할 것이다.

영문 초록

This study aims to examine various risk factors that correctional officers or probation officers can face on their duties using qualitative research method, and explore policy measures to reduce such risks. The result of the study shows that correctional officers were occasionally exposed to physical violence or situations to the brink of violence, or verbal violence. In addition, they often experienced intentional disobedience of orders occurring in their duty or resistance in the lawful execution of their duties. Also, many correctional officers experienced not only administrative risks such as petitions, and request of information disclosure, but judical risks such as charge and accusation. Both correctional officers and probation officers were exposed to excessive workloads, physical and mental stress due to the shortage of staff and low job satisfaction. Furthermore, there were increasing concerns about risks of accidents such as self-injury or suicide by inmates or probationers, which gave correctional or probation officers insecurity about their positions. In this regard, it is suggested that the authorities need to improve such situations in four ways. First, safe work environments and safety systems should be created for the officers to reduce risk factors such as physical or verbal risks. Second, strict guideline and grounds on petitions, appeals, or request of information discloser needs to be established to reduce administrative and judicial risk factors, and more staff need to be filled responsible for lawsuit who are affiliated for Korean Correctional Service or Crime Prevention Policy Bureau to deal with problems more pro-actively at organizational level. Third, human resources of Korean Correctional Service need to be reinforced to reduce physical and mental risk factors to address risks caused by the shift system. Crime Prevention Policy Bureau also needs to establish measures including extension of probational organizations at a proper level and increase in the number of probational officers, adoption of flexible working hours, good use of leisure, and establishment of a reasonable compensational system and close medical examination and treatment systems. Finally, education programs need to be strengthened to prevent or address risks of accidents or problems such as self-injury and suicide of inmates and probationers, with the analysis of more scientific data to be well-informed of prevention measures and rapid handling in case of an accident.
