일본의 고령자 주거 지원 정책에 관한 조망

국문 초록

고령자에 대한 민간임대주택 입주를 거부하는 경향에 대응하기 위해 임대주택 등록제도 마련, 고령자 주거지원센타 설립, 고령자용 우량임대주택 공급, 종신고용임대차제도도입, 고령자 소유의 주택에 대한 베리어프리(barrier-free, 무장애화)공사 지원 등을 내용으로 하는 일본의 고령자 주거안정법이 2001년 제정된 후 상당한 기간이 경과되고 있다. 제정 이후 2011년에는 본 법의 개정이 있었고, 개정은 첫째, 서비스 부(付) 고령자 대상주택사업의 등록제도 창설, 둘째, 종신건물임대차의 인가기준의 변경, 셋째, 고령자 주거지원센타 지정폐지로 그 개정이 완성되었다. 그러나, 이러한 개정의 일련의 작업으로는 고령자의 주거가 안정화되었다고 말할 수없으며, 특히 본 논문에서 지적하고 있는 바와 같이, 서비스 부 고령자 대상 주택의 계약의 복합계약적 성질, 일시 입주금의 법적 성질에 관한 문제점을 향후 어떻게 정의하고 이에 관해 세밀히 입법할 것인지에 관한 과제를 해결해야 할 필요가 있다. 그리고, 우리나라의 주거약자 지원법의 형해화를 방지하기 위해 국내 고령자의 주거안정화를 위한 보다 면밀하고 구체적인 시행령 및 정책적 결심, 사회적 합의의 도출이 필요하다고 본다.

영문 초록

The considerable period of time is being passed after being enacted in 2001 the housing stability Act for the elderly in Japan, which has the contents such as arranging the rental housing registration system, establishing the housing support center for the aged,supplying the superior rental housing for senior citizens, adopting the lifetime employment rental system, and supporting the barrier free construction on the elderly-owned housing,in order to cope with the tendency of refusing for the elderly to enter the private rental housing. In 2011 following the enactment, there was the revision of this law. The revision was finished with, first, forming the registration system of a housing project targeting the service-care elderly, second, changing the standard for approval of the lifetime building lease, and third, abolishing the designation of a housing support center for the elderly. However, the elderly housing cannot be said to be stabilized with a series of this revision. Especially, as indicated in this study, there is a need to solve tasks on how defining the problems about the property of complex contract in a housing contract targeting the service-care elderly and about the legal property of lump sum payment in the future, and on whether or not legislating this in detail. And to prevent the failure in the law on a housing support for underprivileged group in our country, it is considered to be needed the closer and specific enforcement ordinance and the policy-based decision for the housing stability in the aged at home, and the elicitation of social consultation.
