국문 초록

최근 전 세계에서 발생하는 해적의 공격은 줄어들고 있는 반면에 각국의 선박이 피랍되는 건수는 오히려 늘어나고 있는 것으로 알려졌다. 해양수산부 2014년 상반기 해적사고 발생동향에 의하면, 세계 각 지역에서 해적은 여전히 활발하게 활동하고 있으므로 위험해역을 운항하는 선박들의 각별한 주의가 필요하다고 밝혔다. 국제사회에서는 다양한 국제협력 강화 방안을 연구하여 해적퇴치를 위한 국제적 논의와 공조활동에 적극적으로 참여하여야 하는 의견이 대두되었다. 특히, 최근에는 민간무장보안요원 고용 및 탑승 후 해적과 대응시 발생할 수 있는 사안에 대한 국제 규범 제정방안을 검토하여 이를 국내법규로 수용하기 위한 연구 등 다양한 의견이 개진되기도 하였다. 결국, 국외에서 발생하는 해적행위는 우리나라 관할권 밖의 해상에서 발생하기 때문에 자국의 선박과 선원의 안전 확보를 위한 법적보호 조치가 마련이 필요하다. 이에 국제항해선박과 선원 및 해상구조물에 대한 안전확보와 피해 방지 그리고 이를 위한 체계적 대응에 필요한 사항을 법규로 규정함으로써 국민의 생명과 재산을 보호하고 국제항해 질서유지에 이바지하는 정책을 마련하여야 한다.

영문 초록

In recent, pirate attacks occurring around the world is decreasing. However, the number is increasing rather than ship is hijacked it. Pirates of the first half of 2014, According to the Ministry of Oceans and Fisheries Accident Trends, pirates are still actively activities and special attention from ships that fly the risk area is necessary. The aim of the international community and various international research cooperation plan that should be actively involved in international discussions. In particular, in recent years has been to review the international rules enacted measures to respond to the issues that can occur when pirates armed private security personnel hired and then boarding. In addition, we also have to accept different opinions put forward by national legislation and research. Eventually piracy that occurs in a foreign country is necessary legal safeguards are established for the safety of the ship and the crew because of its occurrence in the offshore jurisdiction outside the country. This international voyages safety and damage prevention for the ship and crew and floating structures need one. However, it should systematically respond protect the lives and property of the people, by the provisions in the legislation required to establish policies that contribute to maintaining international voyages.
