국문 초록

교사는 제31조 제1항과 제34조 제1항에 각각 규정된 구성요건요소이고, 다른 조건들이 충족된 경우 교사범으로 처벌된다. 그러나 제31조 제1항의 교사자는 교사범, 제 34조 제1항의 교사자는 간접정범으로 이름이 다르고 또 달리 해석되고 있다. 제31조 교사범은 범죄의 실질적 추진자이고 독자적으로 법익을 공격한 사람이다. 그러나 실행정범 없이는 성립할 수 없는 특성을 가진 종속적 범죄자이므로 임의적 감경의 가능성을 허용하는 것이 좋다. 제34조 제1항의 간접정범은 이름은 정범이지 만 내용과 처벌은 교사 (또는 방조) 범과 같이 된다는 점에서 모순이다. 따라서 이름을 공범으로 고치든가 내용을 명실상부한 정범으로 고쳐야 한다.

영문 초록

Yet many remain unclear about § 31 of the Criminal Code and incitement. Even the term 'Incitement' or ‘Instigation’ neither clearly defined nor adequately. In this paper I have tried to illustrate, to distinguish the Instigation as the criminal act of inciting crime. This approach is essential because according to § 31 of the criminal Code the instigator is only punishable when the instigated the certain criminal act only actually commits. In the case law and literature is just as much attention to what extent the instigators determine the fact, and whether the request has instigated give him an assurance of the offense or quasi taking a duty of action want to be recognized a Instigation. The author considers that no income or recognition of the binding due of act instigated is needed. However, influencing the instigator and thereby made Plan of deed are the necessary conditions of incitement. The Instigator is equal to punish an offender, thus subject to the same threat of punishment like this. Since the worthlessness of Instigator as a perpetrator rated by the legislature equal, exists no option of applying a reduced sentence. Since the simple determination to the act does not come to the culpability of the offender equal, it would have been better to provide an optional mitigation.
