해적대응 무장요원 승선을 위한 국내법 개정방안에 관한 고찰

국문 초록

오늘날 과학기술과 통신수단의 급속한 발달로 인하여 전 세계적으로 국가간의 인적, 물적 교류는 나날이 증대되고 있다. 특히, 해상운송(Maritime Transport)은 일시에 대량수송이 가능한 장점으로 인하여 전세계 수출입 물동량의 85%이상을 차지하고 있다. 이에 따라 해양에서의 안전과 보안의 확보, 특히 선원과 선박의 안전확보는 전 인류의 안정적 경제활동과 지속적 발전을 위한 필수불가결한 공동관심사가 되었다. 그러나, 문명화된 현대에도 해적이 출몰하여 운항선박과 선원의 안전을 위협하고 해상운송에 심각한 지장을 주고 있는 실정이다. 특히, 소말리아 인근 해역에서 출몰하는 해적들은 점차 활동범위를 인도양까지 넓히고 있음에 따라 기존의 해적대응책과는 다른 방안을 요구하고 있는 실정이다. 이에 따라 선사와 선박의 자구책 차원에서 새롭게 도입된 대책이 바로 민간 무장보안요원의 승선고용이다. 소말리아 해적이 출몰하는 위험해역을 통항하는 선박들은 대부분 이러한 무장요원을 고용하고 있는 실정이다. 그러나 현재까지 무장요원과 관련된 국제법적 근거는 존재하지 않으며, 국내법제도 미비되어 있는 상황이다. 특히, 무장요원은 총기를 휴대하고 사용할 수도 있음에 따라 인명사상 등의 중대한 사고의 발생가능성도 높다고 할 수있다. 따라서 국내적, 국제적으로 해적대응 무장요원과 관련된 법제의 마련이 시급한 시점이며, 우선적으로 국내법제의 정비를 서둘러야 한다. 이 논문 에서는 현행 국내법의 개정을 통한 최소한의 근거 마련에 주안점을 두고 해상보안 및 경비업무와 관련된 국내 법률의 개정방안을 제안하였다.

영문 초록

Nowadays, with highly advanced technology of science and communication, international trades and personnel exchanges have flourished day by day. Especially, maritime transport which has the merit of mass transportation, consequently it has taken 85% share of world trades. For this reason, maritime safety and security, especially the safety of seafarers and vessels has become the inevitable common interests for stable economic activity and development of all mankind. However, piracy and armed robbery at sea persistently has occurred all across the world's oceans in this civilized society despite the modernization of ships. This is posing a threat to the safety of seafarers and ocean-going private vessels, which has severely influenced on maritime transport. Particularly, Somali piracy has extended their attack even to the Indian Ocean in more sophisticated way. This changed phenomenon requires new countermeasures for anti-piracy different to the existing several ways such as the Best Management Plan, navy warship escorting and cooperation scheme of international communities. Hence, Privately Contracted Armed Security Personnel(hereinafter PCASP) were introduced as a new self-defense measure to protect vessels and seamen themselves against pirate attack under aforementioned background. In fact, most of vessels passing High Risk Area where Somali pirates appear have employed PCASP onboard. However there is no legal ground and related regulations about PCASP, qualification requirements and operational procedures not only in the international law but also in Korean laws except for IMO guidelines. As the PCASP possesses firearms and can use weapons in case of the pirate attack, there is a high probability of human life casualties and other several derived problems. Therefore it is high time to legislate relevant regulations in the domestic and international legal system, preferentially it requires amendments in some national acts related with maritime security, weapons control and security guard matters. This paper has studied several existing national laws in respect of introduction for PCASP and suggests amendment options.
